Before I say anything, I was looking for advice to win this case from professionals and people that been through the same thing. I have witnesses and pictures but I feel that isnt enough.

This morning, I was headed home on this dark highway. I see a few cars parked on the opposite side and a Nissan 350Z decided to do a U-turn right in front of me, or so it seemed. When all of a sudden he decided to show off and just started doing donuts. So I slammed on my brakes, my tires lock, and screech for about 10-15 feet.

I hit the driver's side rear quarter panel, rear wheel, etc. His airbag deployed and everything. But there his damge was very minimal compared to my lude. Taking a look at my car, the whole front end is wrecked. Bumper, JDM one piece headlights, hood, fenders, etc. I guess the reason my whole front end got wrecked was because I had the flimsy JDM bumper support.

Now, I am having mixed opinions about this. Will I win or not?

I feel he was at fault since he was driving recklessly, consuming the both lanes I can manuever in. I couldnt avoid hitting him. I got the telephone numbers of witnesses and took pictures of our tire marks. Witnesses can testify that he was driving recklessly, doing donuts, etc. Maybe also testify the speed I was going.

Someone else said that it MIGHT be my fault because I have to be ready for anything that can happen on the road. Ex. a little kid running out from behind a car

I'm afraid that he MIGHT SAY I was going 80+mph because the damage to my car is overwhelming.

i dont think there is any way it could be your fault man.. if you're going straight and he just does a Uturn in front of you, and u slam into him, he should be at fault for going in your path.. especially if he started doing donuts right as you were approaching.. what kinda idiot does donuts when a car is coming?

 

hmm...whoever told you it could be your fault is a ******* moron...now was a U-turn allowed at that intersection? if not, right there it his fault...besides when doing a u-turn you need to yield to traffic, which is you...then him doing donuts and you having witnesses...i say you should come out on top...

how old was this driver?

well hopefully you can come out on top of this.. ive come out with something cool on every insurance claim ive ever made.. whether it be new wheels or a color change.. insurance is a lovely thing.

driver was 21 and there were no intersections..
as you can see in the image below, my wheels locked up a little before "HORSE" and his donut marks around "XING" and that was where we both hit

 

There's no way this is your fault man. What he was doing would warrant him a negligent driving ticket at least. You seem to have plenty of witnesses on your side as well. Make sure he pays for this, you shouldn't have to bite the cost for any reason. Good Luck.

damn dude you do have bad luck with this car...didnt you just get it back from being stolen? and its totally not your fault, anyone who says you should be ready for anything like a little a kid... no little kids going to be walking on a dark highway. and because it is a DARK...HIGHWAY(meaning high speeds) he needs to take precautions especially when doing dumb ****.

Whether he was making a U turn or doing donuts his *** should get hammered. My bro was in an accident similar to yours, a 82 year old didn't look, thought he owns the road and made a U turn left from a right turn only lane and my bro hit him. My bros car was totaled the old guy got a ticket on the spot from the police. We got a lawyer and basically we are just waiting for the money. My bro went for doctor visits for like 8 weeks, he is supposed to get op to 10 grand that’s separate from the car which was replaced with an EK hatch the next week. Get the police involved if they haven’t been already it's his fault. As far as I know it would be your fault if you rear ended him in normal traffic situation, but that wasn't normal, whether it was a U turn or donuts it was illegal on his part.

 

Any idea how fast you were going before, and then about how fast when you actually hit him? I think if you were doing 80+ the whole front end would be smushed halfway into the passenger compartment.

I don't think this could have been your fault. And that damage is not excessive for the rate of speed you were going. The car that does the hitting usually has more damage. I had the same exact situation driving my parents minivan when some dumb *** decided to make a left turn in front of me. I hit him, yelled at him, etc. But anyway, you have the right of way and he got in your way. However the skid marks definitely show you were going a little too fast... I wouldn't show that to the insurance company. Just tell them you were going straight and the guy busted a U into your lane and did donuts and you could not stop in time. They should do a phone interview and what not. Stick to your story and you'll be fine. No worries, just get that thing fixed... sad to see

 

Thats f*cked up James. Hope you come out on top which you should, because he was recklessly driving in the middle of the lanes. And since you have numerous witnesses and pictures....i'd say that you'd win. If not.....just kick his *** for being stupid and for ruining your nice 'lude.

the skidmark on the pic actually looks kinda long but in reality, it's only 10-15ft.

what the **** dog.. about a month and a half ago, it got broken into and ****.. got it painted 3 weeks ago and this **** happens. ****!! too much bad karma with this car...

 

man oph, that's some bad luck there. hope it all goes well for you and get everything you need.

 

as shitty as it may sound, the insurance co. will probably still find you partially at fault for hitting him maybe like a %70 - %30 thing. It's happened to people I know before, the jackass wasn't supposed to be in the street but my friend hit him, ended up being partially his fault, for not being prepared to stop or some bullshit like that.
