Before I say anything, I was looking for advice to win this case from professionals and people that been through the same thing. I have witnesses and pictures but I feel that isnt enough.

This morning, I was headed home on this dark highway. I see a few cars parked on the opposite side and a Nissan 350Z decided to do a U-turn right in front of me, or so it seemed. When all of a sudden he decided to show off and just started doing donuts. So I slammed on my brakes, my tires lock, and screech for about 10-15 feet.

I hit the driver's side rear quarter panel, rear wheel, etc. His airbag deployed and everything. But there his damge was very minimal compared to my lude. Taking a look at my car, the whole front end is wrecked. Bumper, JDM one piece headlights, hood, fenders, etc. I guess the reason my whole front end got wrecked was because I had the flimsy JDM bumper support.

Now, I am having mixed opinions about this. Will I win or not?

I feel he was at fault since he was driving recklessly, consuming the both lanes I can manuever in. I couldnt avoid hitting him. I got the telephone numbers of witnesses and took pictures of our tire marks. Witnesses can testify that he was driving recklessly, doing donuts, etc. Maybe also testify the speed I was going.

Someone else said that it MIGHT be my fault because I have to be ready for anything that can happen on the road. Ex. a little kid running out from behind a car

I'm afraid that he MIGHT SAY I was going 80+mph because the damage to my car is overwhelming.

I need help, I need advice, I need sympathy... ****, I WAS IN THE PROCESS OF SELLING MY CAR TOO!!! Thanks for looking guys. I'll try to get pics up when my friend gets a chance to uplaod the pics.

been through 3 ludes, just turned 17, who has bad luck? lol, but hey bro if you can convince the jury he was driving wrecklessly and you couldnt avoid him, you'll be aight, was there any witnesses? if there are and they testify or make statements for you, you'll be aight, that's what happened to me, i rear ended someone that pulled out in front of me, but had 3 ppl say it was her fault so i won

 

you should be fine as long as the witnesses don't back out. From now on make the other driver sign a statement stating what happend. I take it the cops weren't called.

 

Dood that sucks big time. My lil bro just saw your car like I told ya and he was interested.. What did the road look like? 2 lane? one lane going each way? What is the middle dividing line? A Yellow striped line? Some two way streets it's illegal to pull a U turn. My dad did this before... he was in the car making a U turn and despite the guy going well over the speed limit and hitting my dad... my dad was still at fault...

2 lanes each way and a center yellow lane.

 

since you hit him the rear quarter panel, and not directly in the rear, he had to be sideways at the point of impact (thus proving his wreckless fishtails).

Also..he crossed a yellow line? no turning lanes at all?

You should win the decision

 

as you can see in the image below, my wheels locked up a little before "HORSE" and his donut marks around "XING" and that was where we both hit

nah, looks like a low speed hit to me. otherwise your entire bumper would've been ripped off.

did the cops show up?

 

a regular 80mph collision should have folded the hood.

well, it should be pretty easy to show that he was at fault with the way that he was hit and the damage to your car. I know a lot of you guys hate cops and don't like to get them involved in your **** but sometimes its better to call them so you don't get screwed when its obviously not your fault. But i grantee that the judge will ask why the cops weren't called. Good luck man

 

Okay this is what I would do. First speak to the guy and ask him you know do you wanna handle this like gentlemen you know cause I was comin down and you accidentally hit me. Im not sure if you where aware of this but what am I supposed to do now cause look at my car. Then ask him to front up more for the repairs and charge him 200-300 extra so your lookin at 1000-1500 dollars in damages and paintover and some freebee ****. And tell him your kneck hurts alot because of the swipe.


My uncle is a lawer and hes jewish so yeah i had him look at this and he said youll win definitely so just pray that you dont have alot of traffic viloations and you should be straight cause thats the first thing they are going to look at.
If he acts like a complete jackass take him to court and pay off some witnesses or get someone whos in your family but out of your family without the same name. Then get the note notarized and say you have no relation tell them your story make them repeat what happened and if he has x amount of witnesses you have to get 1 or more then him probably 2. was he on his cellphone ? what car was he driving.

Tel the jury you was doin the speed limit and he was lookin one way to get into traffic and he didnt look your way twice as you repeated cause he wass tryin to beat the car into the lane on the oppisite side on the road ,and thats when he clipped your front.

 

If you were going 80 that tool in the 350 would be toast right now. Ask him to do you right and cover all of the damages at a respectable shop. If he doesn't help you, get a lawyer and take him for everything that you can.

 

Unless he's a HORSE, He shouldn't have been crossing... If that's the road, you are not guilty for sure.

first of all. your insurance will cover it... you wont need to go to court to settle this, thats why we have insurance companies. second. the damages are way more than 1500. third. if you do go to court there wont be a jury. the judge will look at the case and look at traffic laws. he will determine who is at fault and he will sentence whom ever to pay the damages.

 

I hope you waited for the cops to show up. I'd let the ins. company fight it, but as long as you have witnesses to him doing donuts and driving recklessly, your ins. co. won't have a problem getting money from his ins. co. You will have two choices - get your ins. co. to pay for your damages, or his (I suggest yours). Either way, your witnesses will have to call the ins. co. (or the other way around). A lot of times the ins. co. of the other driver will play phone tag with the witnesses hoping they'll not care enough to persevere. Tell your witnesses they may leave their statement on the agent's answering machine.

 

DO NOT have yours pay. IF YOURS PAYS YOUR INSURANCE IS AFFECTED. Unless it was an act of god (rock rolls infront of your car). This is something you want his insurance to cover, since that would cover your deductable and all. Fight this thing. THat middle lane is a turning lane, and by the looks of it there isn't a road to the right of the picture that I can tell (maybe there is) so he shouldn't really have even been in there... most states it's illegal to drive in a turning lane for over a set distance. It's also his fault for not making sure the road was clear before making the manuvor (u turn). Also, if he was spinning his tires, atleast in PA in my area, that's considered careless or reckless driving. Either way he should be found at fault

oh, and someone I know found out hte hard way in PA reckless looses your lisence for 6 months.
