I was in the market for a Zex nitrous kit, when I came accross this ad.:

I thought, WOW, what a great deal...I have to jump on it. My friend actually replied to that post, but anyway, I emailed the seller immediately. We ended up sealing a deal for VAFC+$75. I sent out the VAFC before he sent out the Zex kit. I know it was a bit stupid of me, but I figured after so many online transactions, I'd be alright. I sent the VAFC alone without the $75, and thought to myself once I get a valid tracking # from him, I'll mail the $75 immediately.

Here are the emails in the order of which they occured:

Hey I have a VAFC in perfect working condition, thought it shows normal wear
and tear. Would you like to work something out for the kit? Also, is it wet
or dry?

it's a dry kit, it is brand new, comes with everything, and i am also
throwing in a remote bottle opener. how much of the wires are left on the
ecu side? also, i could go 50+vafc for the kit shipped.

Hey Brian, I can ship out the VAFC + $50 tomorrow. Let me know if you're
serious about this. About the wires, 2 inches AT MOST have been cut. It's as
long as it comes essentially. Like I said, the VAFC shows slight wear&tear
but works 100% perfectly. I really don't want to give it up, but "I need
NOS, 2 of the big ones!" - Hahaha JK Please let me know if you're
interested. Perhaps we can both ship tomorrow, and provide each other with a

no, but i assure you there is nothing wrong with it is brand new. i just
took it out of the box about 2-3 weeks ago to look at it. and then i
assembled most of it. and thought about puting it on my car, then decided to
go all motor. that and i need to payoff the rest of my swap. the kit is so
new and clean. it even smells new.lol. i just opened the box for the remote
bottle opener. so everything is new, never been used. i just need money or
parts very soon. i have to run at the track in 2 weeks so i'm trying to get
everything done asap. let me know if you want to make that deal. i've got
about 3 other people to tell them the kit is sold if you want to make the
deal. let me know

Sounds like we're both in the same situation. We both need to be at the
track within the next 2 weeks My car was turbo, but I blew it up, so I

well. my car is still in the shop. the bottle and nmu are in it still, the
brackets and lines are at my house. i just need to get the car back, or go
to the shop when they are open to get everything else. if i can get a ride
tomorrow i can get the bottle and nmu so i can ship it out. it's really
starting to agrivate me, i was supposed to have it back thursday
night/friday morning. and the company shipped the wrong ecu to the shop. and
now i have to wait again.if i don't get it shipped tomorrow, it will be
shipped monday morning at 8o'clock

hey man don't worry, i'm trying to get things done and lined up. i get the
car back monday and i'll ship out then. i'll see what i can do as far as
overnighting it, i might just do that for ya. i'm trying to get all of this
organized and done. and one thing after another stumbles in the way. if the

hey, i just got the car back this afternoon, came home had a note in the
mail saying i needed to pick up a package from the post office. looked at
the back of the card to see what time they closed and i was about an hour
too late. so i'm going to stay up all night until 8 in the morning and go
grab it and send it out priority mail. by the way, jdm h22a and dc sports
header rules on my car . it's really quick now. hehe. i'll get back to you
with the info of when it shipped and the tracking number.

THIS is where the fun starts. He claims an empty package was sent to him, just an empty box. The receipt clearly states the weight of the box. I went back to the post office, and weighed a VAFC, and it was half of what the package weighed (6.9oz). He claims a VAFC weighs over 2lbs.

Brian, you have got to be kidding me. I have three (3)receipts from when I
sent the VAFC. I shipped you the VAFC without the $75, just in case you were
the scammer you're proving yourself to be. I was going to ship the $75 AS
SOON as I received a valid tracking number from you. I only thought it was
fair since I sent out the VAFC before you sent out the nitrous kit. Ever
since we 'sealed' this deal, you have been stalling and making excuses about
the nitrous kit being in your car, and that your car was in the shop, now
you're telling me that the box I sent was empty? The box in fact did have a
complete,100% working condition VAFC in it. You can contact my friend,
Michael ***** at ***-***-****. He was there for the packing and mailing
of the item. Mr. ***** is full ready to testify that in fact the box was
full in a court of law.

This is your final chance to send out the promised goods before I contact my
lawyer and hand this case over to a local collection agency. I intend to
prosecute you to the full extent of the law. I expect my kit no later than
Friday, May 23rd otherwise, I advise you to contact your family's attorney.

postal receipts, that you incriminated yourself. I have a copy of the weight
of the box on my receipt 14.00 oz. Yet, and I quote your email dated May
20th, 2003, "opened the box and there nothing in it man..." Weigh that box
empty, and much to your misfortune, you'll find that it does not weigh 14
oz. This is legal proof of a lie, and therefore, a breech of our contract on
your part. Please refer to my previous email, and as stated before, be

14 oz isn't even a full pound. i've installed vafc's on my friends cars,,
and they weigh roughly 2 pounds with the wiring harness. don't even try to
threaten me here. not only have you breached our contract by not sending me
the vafc and the money. you intended to keep the money after you received
your shipment. you may ask why i believe that? well. because you never even
talked to me about it, you just assumed it would be fine and dandy and that
i would not even notice it. i'm giving you until the end of the week to ship
it all out. or else i will put it back up for sale. if you would like to
take this through litigations. i have about 5 witnesses that were there. i
would be glad to write it up for you. i however will give you a few options.
1. send the vafc and the money. and i will forget you tried to con me
2. send $300 to me and i will forget about you conning me and as above i
will ship the kit.
3.just admit that you tried to con me and appolagize and i will acknowledge
your mistake and not take it any further.
4. take it to court where, i, ryan smith, chris hankins, jonathan erskin,
brandon lamendola, and whasy sherzada will testify to the empty box.

you see the thing is, i probably got 5 emails a day from you. i have sold on
the internet before. and never have i been more suspicious about it, than
with you. you were constantly bothering me, and hastling me to ship it, when
you hadn't even shipped it yet. and i had made it quite clear, that my car
was in the shop, and parts of the kit were in it at the time. i got my car
back yesterday and the empty shipment today. frankly. i am upset. because
the guy who i was talking with offered me 300 cash for it. and you offered
me the better deal. i should have just gone with him. i knew your offer was
too good to be true. hopefully you have shame and pitty, and will act
accordingly. may god have mercy on you.

Brian, there are a few points I forgot to make note of in my prevous emails.
Since the beginning, I have noticed that you made no effort to make this a
successfull transaction. You asked me for pictures, and I ran to my car
immediately, took them, and sent them. I asked if you had any pictures of
the nitrous kit, and you said no. That's understandable, not everybody has
access to a camera or scanner. Moving on, you told me the kit was brand new
and never installed (but out of the box) yet when I go on https://honda-tech.com
and search for threads you created, I find you asking questions about
nitrous installation. Perhaps I should quote it to refresh your memory:

"i have a zex kit, allmost all of it is ready and hooked up.i just have the
white wire left, which is for the tps. now, which wire is it? what color?
and where is it located in the engine bay? the fastest response gets a
cookie and a hehe, the sooner the better that way it's all hooked up."

Never did you ask me for my address, I had to give it to you. Never did you
willingly email me, you only replied to my emails. The reason why I kept
emailing you asking if you shipped my item is because I was concerned you'd
scam me. I even mentioned it, as nicely as possible in a previous email.
Most of my emails to you asking if my item was shipped were after I shipped
your VAFC. I don't know what you were/are trying to pull here. You gave me
four choices, and I'm chosing choice number four.

Your last email has left me speechless. So much so that I went to the very
post office from which I mailed you a VAFC and weighed my friends identical
unit. I took a video of the whole fiasco as proof, and attatched it to this
email. The VAFC came out to 6.9 ounces. Where does this leave us? Not only
have you demonstatred a poor excuse for a con, but you have incriminated
yourself on multiple counts. The weight of the VAFC according to the Federal
Post Office's scale is 6.9 ounces, with a box, logically, 14 ounces. I will
once again quote you verbatim "opened the box and there nothing in it man."
If you had any sense whatsoever, you would not have admitted straight out
that the box was empty seeing as I have a federal document stating the exact
weight of the box at the exact instant it touched the scales via a federal
emplyee's hand. You have caused me a great deal stress, loss of sleep, and
lack of trust in the human race as a whole. I will not stand any such
injustice. This is your last chance before legal action is sought to send me
the nitrous kit. I have vividly and without any shadow of a doubt, proven
you to be lieing, and I advise your friends who are alleged witnesses to
retract any intention to testify, lest they be convicted of purjury in a
court of law.

One last time, in plain english. I have every intent of handing this case
over to Commerical Collection Consultants on Monday morning, should I not
recieve the nitrous kit, or at the very least, my VAFC in the exact condtion
it was sent. Please do not force my hand. It is my sincere hope that we can
salvage any semblance of an ideal transaction (on your part). This will be
the last email you recieve from me. I look forward to one of two responces
from you. Either 1: A confirmation # on either my nitrous kit or VAFC, or 2:
Your acknowledgement of the all the facts I have listed, and that you are
fully aware of my intent to take legal action.

Brian, once again, please do not let this go any further. I am not asking
for an apology, all I want is what is due to me.

honestly man, i don't know what to say. your post has rendered me
speechless. i swear on my sisters grave, that when i opened the box. that
there was nothing in it. the box was a little tattered. but i thought
nothing of it. if you honestly did not scam me, then i do not know whats
going on here. i feel betrayed. i made it quite clear to you. that my car
was in the shop. as well as parts of the nitrous kit. and again i state. the
nitrous kit has never been used. yes, i did put it on my car, no, it was not
fully hooked up. also, i asked you for pictures and i haven't even seen
them, so again, you have failed on your part. i just need ends to meet, it's
to the point where i'll just go by a brand new vafc for 290, have it
installed and tune my car, it is in need of major tuning, and i thought a
fellow tuner such as yourself would understand. but all i've gotten from you
is. "have you shipped it yet". "have you shipped it yet". it comes to a
point that it was quite obvious that you were trying to pull something. but
i thought you'd have the conscience not to do something like that. but hey,
i don't know you. i wouldn't do that. i'm 17 on my own, i've lived a hard
life. i know what is right and what is wrong. i try my hardest to succeed,
and then i run into people who try to pull one over my eyes.

also, if you'd like to take this into a higher power. i suggest rethinking
that idea. i have proof of you saying that you would ship the vafc and the
money. and then you saying again, that you were going to give it to me after
i shipped mine, that is a breach in contract right there. second. i have
physcial evidence of an empy box in my kitchen, i have proof that there is
nothing there. i also have witnesses. your side wouldn't hold up in court.
my side on the other hand has all the proof. if you'd like to try to take it
into legal action, i will countersue. and i will win due to lack of evidence
on your behalf, and overwhelming proof on my behalf. oh well it's your
choice. you forget that there is a middleman inbetween us. the usps.my
advice, would be to take it to them and figure out what happened. please do
not threaten me any farther, for it will just add up to more proof on my
behalf. if you conned me, please just tell me so i don't feel as bad about
the situation. if you honestly didn't then i feel sorry for you as well as
i. we both got screwed out of this situation. not to mention screwed out of
money. think wisely. and act accordingly. do you really want to pay a
lawyers fee just to lose in a case because of lack of proof? or astounding
proof on my behalf?. like i said, if you tried to scam me, just say it. if
you didn't, maybe we could contact the usps and find out what the hell had
happened. i'm fed up with this all now, not only do i have a severely
untuned car, my budget as of right now is empty so i need to sell my nitrous
kit now. you know how to contact me with further info, be careful. and mack
a decision that best suits the situation. godspeed.

I don't know what to say at this point. Maybe somebody did steal it, I wish
I knew, but it really hurts when you call me a scammer. I showed you my eBay
feedback immediately, and have people that can vouch for me on Honda-Tech.
Also, I shipped my package first trusting you. Check your old email if you
saved it, I sent you quite a few pictures from all different angles of the
VAFC. If you don't have the email saved, I do. I saved them all. I work very
hard, every day of the week for my money. Now I have to spend another
$250-300 on a new VAFC.

I have every intent of taking this to a "higher power," and it looks as if I
have to, seeing as you will not comply with my one request of pure honesty.
The empty box in your kitchen is worthless. Who's to say you didn't take the
VAFC out of it? Your friends? For the safety and well being of your friends,
I hope they are not lieing, because along with the felony of mail tampering,
you will all be charged with purjury. Where is the lack of evidence on my
behalf? Perhaps the three federal documents the post office gave me after I
shipped the VAFC or, in plain english, my receipts. Maybe it's the video I
took of myself walking into the post office, and weighing an IDENTICAL VAFC
on a fedral USPS scale. I don't know. If you think your empty box is more
evidence than that, good luck

I am calling after I send this email to file an insurance claim. Please
realize an investigation will be conducted by the United States Postal
Service. As I'm sure you are aware the USPS is a federal organization, so it
is my sincere hope that you are not lieing because if you are found to be,
you will be convicted of a felony.

tough call... hard to say that you didnt scam him...but im not accusing you of it.....either way you have the advantage if this was taken to court because he has no real evidence "witnesses"??? hahah i could just tell my friends what to say too....good luck hope everything works out for you.

what he should have done was take the box back to the post office and showed them! and ask them to reweight it to see if it weigh the same when it was shipped. also did you insured it? how you shipped it? UPS? USPS? you can contact them just in case somebody did steal it out of the box. but i doubt they would know that there was a VAFC in there.

so with the first comment this guy made he must have been in his car when he opened the box. so he must have been drive a van to have 6 people in the car. &lt;which i doubt!. also if the package was never shipped out and he stoped it right away, the post office will refund his money. i say go get his ***!!!!! damn scammers!

You make some very good points, that I never thought about

I sent it via USPS 2 day priority mail, insured with delivery confirmation. I have to call and make an appointment to file an insurance claim.

IMO, that guy is lying through his teeth. I think you handled it well and hes going to get whats coming to him. The point about 6 people in the car is a good one. Hes straight out lying. I also wonder if there would be anyway to find out whether he was actually shipping the nitrous kit out. Like he stated, "he was able to jump out of his car and stop the shipment". See if theres anyway he was actually shipping a package that day. Not sure if its possible but maybe you can somehow contact the post office. Good luck Goldfingiz, this guy sounds like a lying scammer that deserves to be SHOT!!!

File the complaint out, and they will send him and you a letter. They will give him a deadline to resolve the matter. I've done this and it has worked for me, got my money back.

theres more holes in brians story then i can count. For all we know, Jesus divinly intervened and removed the vafc prior to brian and all five of his oddly named buddies opening the box at 8 am in the post office, only seconds after he mailed the nitrous kit, which right after, he stopped from being sent. all in all, I think nick is going to file ins claim, and if that falls through, theres a real good local collection agency up the block that deals with this type of stuff. Honestly, if it were me, brian would be as close to jail as possible.

also. IF he actually mailed out the nitrous kit, than he should have a reciept that he mailed it out! even if he stoped the shipment. so ask him for the receipt that he actually tried to ship it out.
