Default OT: question for paypal users

i purchased something privately from someone using paypal and the shipment never arrived because it was misplaced/lost by the shipper. as per the advice of someone else i went thru the complaints process with paypal and got an automated response to wait 30 days for a response from paypal while they conduct an investigation. meanwhile the seller repeated attempts to locate the shipment and send it to me.

it has now been a month and the shipment has not been found. the seller has offered to refund my money, but is afraid that paypal will deduct the amount a second time from his credit card after refunding me. we have both tried to contact paypal for awhile now and neither of us are getting any response.

i have tried to contact the credit card company, but they have told me that without a bill of sale (how can i have a bill of sale if i don't have the goods???) they cannot do much. the receipt of payment notice from paypal that u usually get after a transaction was apparently not enough? i'm not sure if this is true or false because the person i spoke to on the phone has never heard of paypal before.

has anyone gone thru this before? how can end all of this?

any help appreciated... thanks.

get the seller to refund your money - when paypal has "finished" their investigation - they will ask you if the seller and you have resolved the dispute before they go on with "further action." If so they will ask you to call and clarify that everything has been taken care of.
