3rd gen rust around gas tank lid factory defect?

3rd gen rust around gas tank lid factory defect?
I see so many 3rd gens with rust in the area around the gas tank lid especially around the top. Is this a factory / design defect? What is the best thing to do to fix it up? I'm thinking of trying to get an aftermarket left rear fender and have it weleded on.
