Got in an accident with a drunk driver
Here is what happened. this is the page I'm attaching to the police report. The drunk guy turned right in front of me all the sudden. and the guy was trying to drive away. He went about a block down the street. A witness saw him throwing beer bottle out of the car after the hit

I am so glad that the Accord had good handling. otherwise, i would have hit the other car straight on and it would cause more damage to the car and injury me and my wife. Also I'm glad the Accord held up really well. The Stratus's whole bumper including all the metal inside was totally gone. But the first thing I was thinking when I slammed on the brake was that "Why didn't Honda put better tires in the Accord?".

Damn dude, that sucks. But thats cool that there was witnesses to see what happened. Hopfully he had insurece though.... Good luck to ya with the car.... Hey, hopefully you can take some of the insurece money and put it towards some mods

Glad you are both OK I take it the airbags didn't hurt either of you? I know someone who had a minor fender bender in a Ford Contour and they both had burns on their arms and faces from the airbags.

I'm also glad that the car doesn't come with a side airbag or a curtain airbag... otherwise, i couldn't escape for sure.

About my Accord, I took it to an Acura dealer which has a body shop. They said they'll get it fixed by the coming Friday... keeping my finger crossed.
I am still having trouble with that drunk guy's insurance company. They don't respond to my phone call.

What insurance company did the other person have?
I was in a minor accident last October (was going through an intersection, a 16 year old girl must not have seen me and entered the intersection, hit be on my back passenger quarter panel - no police tickets). It took a few calls to her insurance company, but they eventually sent me a check. They did send out their own estimater, I was happy with his assessment of the damage.
I can see how an insurance company might hesitate to pay the dealer's price, even if their guy is at fault.
get a lawyer. i work at a law office and deal with insurance companies. the other insurance company is gonna try and screw you because thats their job. collect money and dont pay it out. go to a doctor and have yourselves checked out. injuries can occur post accident. the lawyer will contact both insurance companies, yours and the other persons, and let them know they are representing you. this will make the other insurance company take notice. if they keep denying your claim, tell your attorney to file a lawsuit. it is well worth it. you probably wont go to court, but at the least the other insurance company will go to arbitration which you will get a higher settlement. make sure the attorney has the other insurance company pay for your rental, loss of wage if you missed work, and all medical expenses. if you cant wait, you can pay your deductible, and have your insurance company get the money form the other party's insurance. this way you will have your attorney and your insurance company after the other guys. if you really want to be mean, you can also claim pain and suffering which could net you around 2-3k more in settlement depending on the extent of any injuries. just make sure the insurance company takes it in the @$$ cause they are gonna try to do that to you. i hate insurance adjusters

The other guy is using American Service Insurance. It is some very small company for Chicago only. The adjuster finally called me today after I left him a msg again this morning. I told him I am going throught my insurance and then he didn't want to talk.. so I wonder what he is thinking. I hope my insurance company will fight hard for me to get the money back.

(Not that I need an attorney now, but just out of curiosity.)
what did he hit you with? a pickup or SUV? At least it is only cosmetic damage.
As for my car, the frame is bent very slightly... you can see it in the picture

im in CA/ the attorney doesnt take any fees from the repaier of the vehicle. the attorney fees come from making a claim against the other insurance company for injuries, med bills, and pain and suffering. how it works is that you take the total amount of med bills, and mulitply by 3.5 to 6 times, and that is your demand form the insurance company. they wont pay that number off the back, but the attorney will negotiate until you get about at least 3 times your med bills. he then takes a percentage of that. so, you get your car fixed, your med bills paid, and a little extra for pain and suffering. also you should get your car rental paid for while car is in the shop, and extra loss of wage if you had to miss work due to injury. the car is priority first. the attorney wil get that fixed first, and then after you complete your rehab of injury, they send the demand to the insurance company. your settlement may take anywhere from 1 month to 3 months depending on the insurance company and if they want to be dicks. this can be done on any auto accident. have your wife go to the doctor and you should go also, just in case. if you can, get the police report. the attorney should do all of this, so remind him. hope your wife feels better, and good luck with your car and repairs.

I'm not the type to just yell 'lawsuit' at any opportunity but you need to screw the dumbass over for drinking and driving and teach him a moral lesson. Good luck.
Here in Florida my wife's car was hit in the rear end as she sat at a stop light by a drunk driver going est. 45 mph. He was arrested for DUI and ticketed for driving with unsafe brakes and was driving a pickup owned by a construction company. Her car was pushed into the car in front of her who was also pushed into the car in front of them. My kids were also in the car, luckily no one suffered permanent injuries, but my wife was out of work for a week with pain, both kids had no injuries. The insurance companies really tried to screw me over, saying they could fix a bent frame and everything, I had to really fight them before they agreed to total her car. I called a few attorneys and they told me in the state of Florida unless there are permanent injuries, no pain & suffering is collected. One lawyer said he could work around that, but I accepted the general consensus and decided not to pursue. In the end it all worked out as far as paying off the car, paying for her lost work and medical bills. But I sure would have liked to sock it to the b*st*rd who hit her and his insurance company.
