Legality of selling a car with a test pipe?
I apologize for the slightly-OT post, but a lot of y'all have tree-killers, and some have maybe sold your cars with non-OE emissions stuff.
Friend of mine bought a '99 GS-R from a Dodge dealership that has had a lot of work done. Signs of a recently-removed fuel controller, what appears to be the plate for a wet nitrous setup, 2-piece header, test pipe and GReddy exhaust. Maybe cams as well, from the way it runs.
Aside from all the other crap, is it legal for a dealership to sell a car with a test pipe? He's there now, and they're going to take the car to a muffler shop and see if they can get it to pass emissions, likely by throwing a cat and cheapo exhaust on there. Should he be allowed to keep the test pipe and the "emissions-legal" exhaust they're going to have to rig up?

putting a test pipe on any street car is NOT legal.....period.
your friend should ask the dealer to fix the problem (test pipe) before buying the car or ask the dealer to do the "emission inspection" for him.
I also don't think it is legal for the dealership to sell any car which is not emission-legal.

I believe as long as the dealership resides in a state which requires emission testing, they have to sell cars that have functioning emissions equipment.
I don't think just because the dealership is located in a county which doesn't have emission testing, gets them out of the standard. ('cuz what if someone buys a car from one county that doesn't have emission testing, but resides in a county that does?)

...actually, he can require the dealer to purchase a factory Cat. to install on the car, as it was illegal for them to sell it like that. And if it is one of the bigger dealerships, IE authorized Honda/Acura franchised dealerships, they should've undergone atleast SOME type of inspection. I wouldn't feel safe knowing they missed an obvious test-pipe while looking at the car on a lift and inspecting everything else, including the brakes, et al.
You can sell a car "as-is" can't you?

True, but I thought emissions were a different kitty altogether. Federal laws and whatnot.

EVERY post 1975 car sold in america has to be emmisions legal according to the clean air act. The only out for this is if the car is Race only. Your friend can put plenty of pressure on the dealership, including calling dahmler-chrysler and putting pressure on from a corporate level. Personally, i think it is pretty stupid to buy a car that was obvoisly reemed like a freshman at a frat party, but maybe thats just me.

The dealership is putting a cat on the car as we speak and doing the emissions testing for free. We'll see where that gets him.
