Default 98 ex swap question

alright fellas help me out here. it's that time to do the smog on my civic and yesterday when i took it into the shop the guy told me my car would not pass for 2 reasons. 1 the air intake isnt stock and does not have the sensor anywhere on it and 2 he said the car has a D15B engine and since my civic is a 1.6L it's a big red flag. he said I need to call the state ref and have them look at it to conclude if it can pass smog or not. is this really true, or was he just giving me bs, and if true what engine can I swap back into my civic to make sure it passes smog legally? he also ran the scanner and said no codes at all were popping up at all.

****, california....you're screwed....

You'll have to locate the stock intake and IAT sensor and follow the rest of what he said.

if you’re in cali like the above post suggest

Least headache route:
buy a full swap 96-98 d16y8 along with the engine harness
also I believe cali strict on motor swaps and vin stuff?
so get a notarized bill of sale of the engine?
