Icon5 k-swap starting problem

I got a weird situation going on with starting. Car specs: 2000 Honda civic ex with a 2003 K20a2 and a 2003 type-r trans with Hondata Kpro.
I originally swapped the car with a k20a2 type s and type s trans and everything worked great no issues or check engine lights.
so i purchased another k20a2 had it built and got the new type r trans. swapped everything over and had it tuned. ever sense the car was swapped with the new engine it has had intermittent starting issues.
some days the car starts normally no problem, other days it doesn't start at all. But i am able to jump the starter from the starter post (ignition 12v on) to the battery and the starter starts normally) when the car isn't starting the dash lights come on but their is no click. (I'm assuming the solenoid isn't getting any power)
-Battery is new (and always works when i jump the starting post)
-ignition switch is old but car doesn't die
-cranks over when it wants (generally more often when the car is cold)
-tuned by church so i trust all his tuning.
could this be the ignition switch? or is there something else stopping it.
does anyone know if the starter is controlled by the ignition switch or does the ignition switch send a signal to the ecu to send 12 volts to the starter?

Did you test the starter switch located at the top of the clutch pedal?

Start by inspecting the blue plastic stopper that presses on the switch button and whether the switch position is properly adjusted.

Note: The clutch pedal has two switches. You are interested in the highest of the two switches.

It starts with the ignition switch. Turning the key energizes the wire to the clutch relay and switch. If the pedal is pressed, the relay closes and passes power to the wire that goes under the hood to the starter.

The ECU is not involved in whether or not the starter turns. The ECU does get a signal from the starter circuit to tell it that someone is trying to start the car, but that is only an input. The starter operates directly from the ignition switch and clutch interlock.

that is exactly what i wanted to know. I cant test the ignition switch if I'm not at the car. so saying "so test it" doesn't answer anything. I appreciate the help but not the trolls.
