Icon5 Transmission Grind In 5th

I am doing an auto to manual swap on my 2000 civic. I have the transmission in and everything done except I am still waiting on my clutch master cylinder. I have the wheels up and I figured I would put it in each gear and start the engine to see if there were any problems. When I try to start it in 5th gear it grinds horribly and I think the shifter is pushing out of gear. I only did it a couple times for a half second each time. The other gears sound fine.

Did I get a bad transmission or is this normal with the wheels starting from a stop? I am assuming its not normal. I drained some of the transmission oil and I did not see any chunks of silvery grit in the oil.

Has anyone had luck with jdm parts resellers making good on large items with defects like transmissions?
Thanks.

UPDATE
It appears to be normal. I am waiting on clutch master cylinder parts which is why I have not just test driven it. With the engine running I shifted through the gears. I was surprised it does not grind changing gears without letting out the clutch. Anyway if I get the wheels spinning in fourth and then shift to fifth there is no grinding. I guess the two shafts need to be spinning closer to the same speed. It did grind if I shut the car off while it was in fifth.
