Default Type r trans eating 5th gears

I inherited a type r tranny from a friend that is going k. Before he pulled it 5th would whine and eventually stopped. We pulled it apart and 5th is toast. This is the second time that it has done this.

The first time he had someone put in an ls 5th and the out come was very similar to this time which was with the original type r 5th.

Besides the fact that the person that swapped the gears is not too bright and won't be touching the trans now that its mine. What are people's thought in what is causing these failures. The only thing I can think is that when the person put it back together they missed a shim somewhere and that is causing the misalignment of 5th.

Also while I'm in there I plan to freshen the tranny up. Any suggestions in brands of synchronize or should I just stick with OEM replacement parts. Going in a b16 turbo crx shooting for 350-400 HP.

Any help is appreciated.

I would assume mismatched gears or a clearance problem maybe the needle bearing the gear rides on.. Idk im not really a tranny guru.. For synchros i went with synhcrotech carbon synchros and so far so good smooth shifting but tranny only has about 1000 miles so far.. There's a couple of people in here who are more knowledgeable than me who will probly chime in.. Good luck
Also when you pull it apart make sure the oiling holes in the countershaft and mainshaft are clean of any metal shavings or anything else..

Is it breaking the gears or just burning them? If the latter, it is either being run low on fluid or the shafts are clogged up. Incorrectly shimmed MS generally won't let it break gears (when OEM gears are used) unless the shim is left out entirely. Even installing the CS 5th upside down shouldn't cause a break, but will prevent it from engaging 5th.

So it's breaking the teeth. After looking at it closer. It looks like it was installed upside down. Which is weird because it would engage but would whine really loudly. Still not sure if there is a shim missing or not. I will also make sure to check the main shaft like was suggested.

Is it broken or chipped? There are only two shims in the trans, one above the top mainshaft bearing and one above the top diff bearing. Both in the case. Top being the passenger side.

Is the oil chamber plate (bent steel plate with two bolts in it) still with the correct bend to it so oil is channeled up into the oil trough? That combined with clogged oil orifices in the mainshaft can cause some serious issues. Especially if also coupled with low fluid.
