What the hell is suspicion of DUI? Either you're DUI or your not

 

He probably didn't take a breath test only field test. So they technically can only suspect he is under the influence. Hence the reason any good lawyer will say if you ever get pulled over and are drunk don't say a word and don't take any test.

 

here in MI if you dont take the test its automatic guilt and 1 year suspended license. kinda messed up.

Same law here in NC.

 

Plus if you get a dui here you can get a privilege license to drive for work, school, or court. If you refuse you will not get a privilege license.

Automatic suspension is nothing. Reason being is if you refuse to blow or take any test THEY HAVE NO EVIDENCE YOU WERE DRUNK! Any decent lawyer can get you out of this. The only natural thing that has the same reactions as drinking is lack of sleep/being very tired. That defense is used over & over in court for DUI cases, with no proof on the officers end.

Edit: I dont mean falling down, puking, type drunk. I mean slightly inebriated

Funny i always thought the same thing about refusing the breath test. I actually asked a very good lawyer about it after my dui thinking i should have done that, and he told me never ever refuse for the very reason i stated earlier because you will lose your license and you will not be able to get your privileged license. Not trying to be a dick or start an argument by any means.
