OT - do I have to tell a buyer that.....
Hey all,
Do I have to tell someone who wants to buy my 1999 Civic Si that the engine is not the original engine? More of a legal/ethical question than anything.
I returned everything back to stock, bought an engine from IAS from a 1999 Civic Si w/37,000 miles on it (my car has 53,000 miles). The engine and trans is perfect, and I've been driving it around since last April.
So far I've told everyone and they never seem to call back
At $13,750 it's a very good deal.
BTW the SSR Schumachers are for sale separately for $1200 OBO with newer Kumho 712's.

I would. I think it's very shady if the seller doesn't disclose information about the vehicle.
You have to ask yourself if you can live with yourself if you don't disclose the information.

Yes you do. And you need to provide papers with that motor prooving that it isn't stolen. A receipt from the place you bought it from should suffice.
You need to also disclose that the mileage on the odometer does not match that of the motor.
If not, and the buyer finds these things out, you will find yourself in court and possible criminal charges could be filled against you, and/or you will get the civic back and give the buyer a full refund.
For your protection, I would put the stuff that you are disclosing to him in writing, both of you sign and both of you get a copy. That will protect you in the event that he tries to get out of the deal etc.

If you mark that the mileage isn't actual, your ok. You don't have to tell them its not the original motor unless they ask. Selling a used car is an "as is" transaction. It is the buyers responsibility to have the car checked out by a mechanic before purchasing a vehicle. It is illegal for you to lie about the car. Not telling is not considered lying. If you mark it as actual mileage, that is considered lying and then they can sue you.
I've watched enough peoples court to know this info is 100% correct. Its more of an ethical question whether or not to tell them. I would tell them just to be ethical. I would want someone selling me the car to tell me the truth.
Also didn't that car cost 16K brand new? 13.5K isnt a very good deal for a car without the original engine. It doesn't matter if its better or just as good. Most people don't want a modified car for fear of other problems. Thats probably why you haven't had any people call back.

seems like if the engine is newer than the car that you'd *want* to use that as a selling point. maybe i'm missing something here
How come you are selling your Si? Wasn't your Si the strongest N/A Si in the... nation? i remember reading about your car a couple years.. yes years back. i think you transplanted into your CX as a project car? i dunno, but good luck. disclose the information. your car is sweet.
Be Honest
It's the right thing to do.
You don't want it to come back and haunt you.

Ah, but I have over 180 views of my car....which is for sale BTW
My SI is also for sale and I have had a lot more views.....
dont tell them on the phone ...tell them to come look at it..drive...have all your documentation ...and receipts...tell them in person about the engine situation ....why it was done ..were it was done ...proof of the engine legality ...etc ...its much more easier to understand in person ...with proof , rather than just telling them over the phone
Thanks for all the help everyone.
I just need to sell it, and of course I will be honest and forthright. (sp?)
I'm just in a tight situation right now. Selling my house and car, been laid-off since March. Everything is just collapsing around me, but ya'll don't want to hear that.
Has anyone here sold a car on ebay? Is it a pretty good way to go if you need to sell it?
