Ok so I'm leaking oil gasket looks torn up. Never did this before so how's the right way to do it? Silicone or not? And how tight? I went to tighten the 1 that's on there now and it just leaked even more so any help?

You clean off the surface real good. Then apply a very thin coat of high heat silicone. Then place the new gasket on, place the pan back up, and install all of the bolts a few threads in at first to ensure the gasket don't shift. Then tighten them up, evenly in a cross pattern.

Thanks a lot 1990edsedan I will try this when I get off work I'm just worried about the gasket shifting hope it goes ok. Either way its better than paying some mechanic $120. Once I do this I will let dry for a long time.

No probs, just make sure you get a good quality silicone. Remember, thin coat.

Make sure to remove all traces of the old gasket material using a plastic gasket removing tool and wipe the mating surfaces with some form of acetone. Apply RTV (high temperature silicone) to the four corners of the pan. Have the gasket prepared to lay down on the RTV. Initially thread the center two bolts loosely, then begin tightening according to the pattern below. The torque specification is 9 ft lbs./12.2 NM. If you are going to perform automotive repairs without previous experience, at least spend the $25 to purchase a Haynes manual from any auto store as a reference source.
