Default Brake light malfunction

My friend has a 98 civic ex and he has been having trouble with his tailights. He tells me that when the car is turned on or off that the driver side tail light and the 3rd brake light stay on all the time, but the passenger tail light never comes on. He said even when he presses the brake pedal, the passenger side doesn't work. The only way he can get the tail lights to stay off is to disconnet the battery. The turn signal and reverse lights work on the passenger side but none of the brake lights do.
My thoughts were it's either the brake light relay, or the brake switch thats behind the pedal.
Any ideas guys? Thanks

There's no brake light relay, but definitely have him check whether the rubber stopper that presses on the brake light switch at the top of the brake pedal has fallen out or is damaged.
