That around 10:30 PM on October 14, 2010 we, the ITR community, lost 00-1330....

I allowed my cousin to borrow my PY ITR for a couple of days and the outcome ended up being a disaster.

My cousin was a block away from his home, when apparently a middle age women, drunk off her ***, ran the red light and slammed into my beautiful ITR. According to my cousin, she was going to t-bone him but he slammed on his brakes and she got the front end. She apparently then tried to evade him by running away, lucky however another driver chased her down and stopped her a block away. She was apparently arrested and taken to jail. I keep stating apparently as I was not there and I do not know the facts till I receive the police report.

I had to make the 70 mile drive out to Fontana to see my baby. I have never really cried over a car, but this time I shed a few ..... I think it was because I had to do so much to purchase her and not to mention that to this point I did all the labor, with help of friends of course.

Everyone is okay, my cousin is a bit sore but he doesnt want to go to the hospital.

Now for advice as for insurance. Can people give me insight into this. I DO NOT want to lose any money, though I will because I wont be able to make it into work in 2 more hours.... Please give me any advice possible. Should I take anything off the car prior to the inspection, the inspector will come by on Wednesday, so I have some time. Or do I wait till after. I think I can still pull the engine, but not sure yet. I know Mugen exhaust is most likely fine. The front end is pretty much all gone.

I feel so bad for my car.... all that hard work has gone down the drain. I will post pictures later.

As for the lady, I truly want to press charges against her, but I do not know if I am capable of doing that, as in if that is an option that is given to me. But on the other side I am trying to move on since its just materialistic lost....

It makes me more sad that I lost her only 4 months into owning her.

hopefully insurance will give you close to what your entitled to. It may help that you just got it too...

1. get a lawyer
2. go to civil court, sue the bageebees out of her
3. tell the court that you use your car for everything and its a HUGE loss beyond belief. Also tell them that it is a very rare model that is virtually irreplaceable, hence you should be rewarded more than the actual appraised value of the car. reiterate the fact that she was drunk, and it was it hit and run/
4. go to criminal court and testify against her. Tell the court you were distraught over the fact that, you could have lost your cousin to this person
5. Take the car to a body shop and get an estimate of the total damage and try to recover the full cost of repair. Get the R fixed properly

2 things for advice....

1. Ask them how much they will take to buy the car back, if worth it buy it back.

2. Make them buy you another ITR with same mileage and dont settle for less, you are entitled by law to receive the exact same thing you had before. Find as many for sale ads for ITR's and present them to the Agent. Don't SETTLE OR SIGN ANYTHING until you get what you want.

If this lady is truly 100% at fault they are at your mercy, find a MINT PERFECT ITR and say you want it.



Last resort if they dont give you what you want, tell them YOU ARE GETTING a lawyer see if that scares them (if you tell them you have a lawyer they wont talk to you anymore). If that still doesnt work go talk to a lawyer about it, lawyers usual give FREE consults especially in these kind of situations. Youll prolly receive a bunch of brochures in the mail anyways.

 

Sorry to hear about your car that sucks.

First I would not take anything off the car unless you can replace it with stock parts.
Make sure the insurance man has a full list of all aftermarket parts and prices for them,they may want proof of prices.
When they make you an offer make sure they are basing it on an integra typeR not just an integra.If they won't pay you fair market value then call your state insurance regulatory board and see what they can do to help you out.

You must be very close to your cousin. There is absolutely no way I'd let anyone, and I mean anyone, drive my ITR for an extended period of time.

 

That's true, I hardly let my dad drive my car and it's just a crx lol.

Wait for the inspector to come and tell his that's a rare model and not just a base model integra and that everything came overseas and he shoudl appraise the car a bit higher.

Sorry to hear about your loss...but before anything, you better make sure your insurance company covers anybody that drives the car and just not you. I'm just saying because some insurance company have policies that does not cover your car if driven by another driver. So if that's the case and the lady does not have any insurance...it's SOL.

ASAP, I'd take as many clear pictures as you can of your caR as it sits....especially all the aftermarket stuff on there. The problem is...the longer an ITR sits in an impound lot...the more parts that seem to walk away. Then you have to prove those expensive parts were actually there. Personally, I'd grab the badge as a memento.

Definitely don't settle for less than she's truly worth. Hopefully your cousin was fully licensed and insured so her insurance can't argue anything. DWI should be a no-brainer on fault.

This is spot on as far as going to court...

For insurance, my experiences usually start with an agent coming out and inspecting the car, wait a day, they say it's totalled, I take the buy back option for a grand or so, then get the check.

I don't know how it is out there but as I remember reading in my policy in New Jersey, the insurer is NOT responsible for anything involved in a DWI accident...it's a stipulation in the policy, it's void once you get the behind the wheel while under the influence. If you have full coverage, kudos, youre provider will be going after her. If not, have fun in court.

 

x3.. But I will suggest this to you. Since this has happened twice with me and my family. Take your cousin to the hospital and get him checked out. No questions asked. They are liable for the cost because they have potentially hurt your cousin and documents are proof of everything. Let the doctor THOROUGHLY check him hea to toe. Don't leave one ache or pain out. He might not be affected now.. but could be down the road. I was in an accident and felt fine.. just some pain in my back.. Now I have constant back problems 2 years later... and I'm close to 21.

Trust me its worth the hour or 2 of your time.

I'm really sorry for your loss man! I'm just glad everyone is ok. As far as the criminal court side goes I dont think you will get very far with that unfortunately. Since she has already been arrested for DWI and most of the time damage to personal property (such as a car) is handled in civil court, I wouldnt think they would tack on any more criminal charges no matter what you told them. Just sue the pants off her in civil court for damages to the car, lost wages, and pain and suffering. Good luck and once again im sorry for your loss.

 

if you can press charges on her..i bet that wasnt the 1st time she was drunk behind the wheell...next time she could kill someone...shes better of locked up than free to drink and drive..

in all seriousness, do what MiraiZ said. always try to see if you can repair the damage and how much it will cost. each ITR is special, and replacing a broken one with a new one wont feel the same.

A few things mentioned above I agree, a few things I don't.

Remember that if her insurance company is screwing you over, as long as you carry collision coverage you can always fall back on your own company to handle and subrogate her company for your expenses.

Provided AS MUCH DOCUMENTATION AS POSSIBLE, and plan on buying back the salvage.
