Default Bottom of Countershaft 1st gear rubs against Ring gear, is this normal?

the bottom face of the countershafts 1st gear is rubbing on top of the ring gear and makes it hard to turn, is this normal? but when u put the outter casing on and pull up the countershaft to clip the C clip on it spins nicely....
The original countershaft had broken teeths so we relace it with a use but in good condition countershaft. lmk guys

Normal. Countershaft doesn't use a shim or spring washer, the c-clip holds it in place.

will the transmission make a whining noise if a different countershaft is used with the transmission original ring gear?

when the original countershaft was in the tranny, it spin freely without the c-clip, but when we swap a different countershaft in with the trannys original gears, it was hard to spin, i mean u cant really spin the gears unless u took a 32mm socket and a ranchet to turn it. but when u put the outter case on and clip the c-clip onto the Countershaft, it spins fine. But now it makes a whining noise when u drive the car.... any thoughts??

LSD or not doesn't matter, there are no axles so the trans is unloaded.

Putting the case on lines everything up correctly and holds the CS in place once you get the c-clip seated. The ring gear and countershaft should not have been mixed and matched.
