Default hit and run.

my prelude got wrecked yesterday. totally gone but ima part out some parts. but i was wondering.. whos fault is the accident im going east and the other car is going west it was green light. and hes about to make a left, so i have a the right away to go, but he turns when its yield for him his passenger headlight hit my driver side headlight. wells that how the collision happens.. he comes out and says "you were speeding" but i was going 40 mph which is speedlimit and i sed " we had the right away" and when cops come he flees.. but luckly the cops got him he just did a big crime "hit and run" does that mean i automaticly win the case in that car accident?

That's how it is here. I'm sure it is in CA, too. There are special circumstances, but your case doesn't fall into any. All you'd have to do is ask your insurance company. They'll know the law better than anyone here.

Him trying to run away isnt a auto victory he probably didnt have insurance.

even if he didn't run, you had the right-of-way, so the accident was not your fault. he failed to yield on an unprotected turn. just talk to your insurance and make sure you filed a police report.

Because he knew he was at fault and he probably realized you had witnesses, or at least witnesses at the scene. People who are guilty run. People who are innocent, do not.

okay its time to get a lawyer now i got police report and all that stuff just waiting for it to process. hm how much you guys think i can milk off this guy's insurance?
