Default ARRESTED AND BEATEN BY THE FONTANA P.D'S ''SMASH'' UNIT

PLEASE go easy on me im sore and cant type right now

i was at my friends house looking for somwhere to eat we ended up at this little mexican place on Foothill and Cirtus ate bullshitted with my friends for a little bit when we were gonna leave i ended up driving i was headed west down Foothill i made a right turn right before Citrus as im driving down this small side street i noticed a cop car coming toward me i didnt think anything of it and kept driving as we passed eachother he flashed me with his spot light but he keeps going the same way he was headed

i made a left turn at the next street and parked before i could even get my seat belt off i looked up and saw his lights in my rear view mirrior he walks up to the passenger window and orders everyone out of the car he cuffs my bestfriend and his friend and myself
i couldnt believe it i kept asking him what we were being arrested for and his answer was for ''EVADING"

I nearing lost my [freak]ing mind I YELLED ''WHO THE [freak] WAS RUNNING''????? i was upset we had done nothing wrong and were being harrassed for being blad we were all bald and were being treated like gangbangers he drops me to the floor with his foot i fall down chest first ending up knocking all the wind out of me he jumps on my back and pulls my arm over my head i look up at him and i ask him why he is treating us this way and his response to me is ''BECAUSE IM SMASH being the dumb **** Orange Country kid i am i asked him what that meant he response ''IT MEANS I CAN DO WHAT EVER THE [freak] I WANT AND NO ONE CAN DO ****!!!!!! there was a famliy standing across the street watching the whole thing he tells me thats the only reason he didnt send us to the hosiptal when we get to the Fontana jail he grabs me out of the car and says to me that if i tell anyone about what happened he's gonna make sure i do a year in jail so im thrown into jail with a $75,000 bail and sore ribs and a very sore back i was bailed out by my parents after i told them what happened
im gonna fight my case till the end


my question is "CAN THEY DO THIS"??????????

treat us like animals and charge us with somthing we didnt do
i want this piece of **** to lose his job for making me fear the police
they made me feel like i cant trust them

does anyone know of a lawyer i can ask some questions

please if u have somthing stupid to say do me the favor and shut the fvck up
i dont need any stupid comments

to keep it itr related his my baby still looking pretty

cops like that are pieces of ****, he needs to mysteriously die on duty. He can't do that and if you get the right lawyer you can make some money off of this, I would immediately go to a doctor and have them write down your injuries, it only helps out.

I was thinking the same thing! Don't let this linger on man! You did what was right by not resisting arrest.

So you honestly want us to believe that you did absolutely nothing to trigger all of this? If the cop was that rogue, do you really think he'd still be on the force?

There are two sides to this, I'm sure. You don't just get sent to jail with a $75K bail for 'evading'.

You should hire Rodney King's lawyer, perhaps.

not surprised, i worked for the la county sheriffs department for 10 years.(work as a private investigator now) and there are definitely more than a few bad apples.

some tricks that ive seen done.

evading. the trick is to call in the vehicle evading to dispatch and wait for the vehicle gets several blocks away before pulling the car over. if you know the area which most cops do, there will be no cameras, and no people walking on the street (hence side street at night in your case)

the fact that you raised your voice appearing to show aggression towards the officer, if he was putting the cuffs on you at this time. just by you yelling and moving your arms in any way except keeping them behind your back, will get you slammed on the ground and most likely charged with resisting arrest.

not sure what else happend to get you the extremely high bail but good luck.

get a lawyer to get a copy of the nights disbatch recording and work on getting his PPI or personel performance index and see if there is any past disapline on the officer.

wow, from what you say it sounds horrible, i would call the county and get put threw to the sargent or whatever top dog is and have him get the video footage from the cops car camera, or just go straight to a lawyer to get the tape, or something along those lines,

Get a lawyer and get that guy fired. No one wants a person like that on the streets harassing people for no reason. You can probably get some money out of it also

I have had to filed complaints against 2 separate "public servants" and i use the term losley, for blue lighting and talking trash to my wife. You cannot let this behavior pass, they count on your fear and will contine until someone stops them.

If you look at the qualifications to become a cop it should be of no suprise that there are more than a few bad apples.
Document everything, no matter how small.
Get a lawyer, file complanits with the department , apply some pressure to this SOB, at the very least it should go on his permanent record.

I hate when people play the race card but if your a minority the ACLU/NAACP might be an option as well. In this case is seems very appropriate.

Also, take the guys name from the report and check the public tax/parcel records and see where he lives and what kind of property he ownes.

This is a true example for the power cops have going directly to his head, i have had friends that were pulled out their cars bullied around and then let go with nothing.

Its not right to see this happen and i hope that you fight it, good luck

There was a time when citizens were innocent until proven guilty...... thanks to contributing to lowering that standard.

You can say that again!!!!!!! I'll never forget this one cop that profiled me (just because my hair is long) and harrased the **** out of me for weeks. Pulled me over one night and told me to go home. I laughed and he got so mad he started studdering. I politely told him eihter ticket me or let me go and would go home when I deamed it necessary. Fortunantly he never bothered me again.

I make sure I go out of my way to tell cops that I know they have big shoes to fill and I appreciate what they do. But in no way will I tolerate a cop harrasing me for no apparent reason, period! Don't loose your cool for then they have you playing on their field under their rules. Use the law to vent your issues. Thats what lawyers are for.

Yes, you need to make sure any physical damage is documented right away before anything can start to heal. I was in somewhat of a similar situation a few years back, but the officer made sure I was left with no marks so it would have become my word vs his. And also make sure you get a GOOD lawyer. It didn't help me that mine sucked.

i'm not too well up on american laws but here in Ireland if this was to happen to me i'm sure my solicitor would be asking the police for more than just "evading" as evidance.
what i'm trying to say is what exactly you were trying to evade?? if they have nothing else on you such as no insurance/license, drink driving, drug possesion etc, then why the hell would you be trying to evade?
we have a government run "police ombudsman" here in Ireland who if you feel you have been mistreated will take on your case against the cops.
we certainly have our own fair share of bad cops as well

You're telling me that you think we're getting all of the information?

$75,000 bail. Either the OP has some serious past history or were missing a huge chunk of the story.

Absolutely it should be innocent until proven guilty...but I find it very hard to believe that a cop would drag someone through all of this for 'evading'. While some cops might be idiots, they still have their pension, family, job, etc. on the line.

It doesn't add up, period.
