Default Difficult finding a 99 and up LS motor for my Civic

I'm having a lot of trouble finding a OBDII 99 and up LS motor for my 99 civic. I know I could just get an OBDI and convert the harness and run it like that, but it wouldn't be CARB or BAR legal correct? also, assuming it has passed BAR, could it be smogged since it has been certified? I want to do this swap just to get better torque and not have to use 91 octane like on Si motors and GSR motors. Going for fuel efficiency and a little more pull for a good price! What should I do now?
