Yesterday, my '92 HB got hit by a Ameritech service van.
The accident was caused by the other guy.

Now, my insurance company wants to junk the car, cause the damage is $3,600 and the car is valued at $3,000. But I've put $5,000 on this car so far.

How do I not loose this car and my money?

 

You should be able to buy it back from the junkyard for stuff that isn’t broken.

For the stuff that was damaged you have lost.
If you didn’t claim it on you policy you won’t give you money for it.

 

ask to buy it back from them totalled for nominal $$$. then get everything worth getting off of it and junk it. start over. if it got hit by a van and they totalled it its probably not worth fixing. you can get civics for so little now anyway, if you look hard enough.

 

well first off HIS insurance company should be the one taking care of this not yours if it was his fault.

Buy the car back from insurance for cheap and then find a new shell to swap everything into.

 

Exactly.....I have a friend who did that with his 5.0.....insurance gave him 5,000 and he bought it back for $575.

Just like Fah Q said..he hit your car..his insurance has to pay for it, and they have to give you the money to replace the car if it was totalled. Depending on what insurance company, you shouldn;'t have to junk the car and buy it back, but if so, do that, and keep the 2500 bucks and the good parts, and sell the car to a junk yeard for 50 bucks..then get a new one and start over...good luck

Unfortunately, in the great state of Michigan, we have the "no-fault" insurance law, where in an accident, it's literally, no one's fault. Also, my insurance has to cover my damages and his insurance covers his.

And of course, I have all the reciept.

 

no fault insurance

has to be one of the stupidest ideas in the world. instead of being allowed to have someone else take care of their problem when they are at fault you get to deal with it, and have your premiums go up.
