Default Wrecked my S2000 today....... have questions now

Well sadly I got hit by a lady today in the country town of Manchester TN. I was merging off the interstate in a construction zone and when I merged over a lady did the same when I saw her I could'nt do anything and she hit my rear 1/4 and door. The dick cop said it was my fault of course it was a case of a small town cop being an ******* to a kid with a car.

Anyways I have a question about the damage and insurance quotes. I hear that if the damage is up to 50% of the vehicles value they usually salvage the car. I love my car and all but I do not like having cars with previous accidents. I am going to get two quotes from shops I know tomorrow.
Any ideas or input on the damage and insurance would help me greatly. Thanks

each company is different.

The general rule is, if the repairs cost more than the value of the car, they'll total it. Without any estimates, I can't tell you what they're going to do.

I've seen cars worth 20k require 18k in repairs and they didn't total the car, so like I said, depends on the company.

my sisters used to work for American Family insurance and IIRC they total your car if repairs are more than 40% of the vehicles pre-wrecked value - so again it varies alot by company.

yeah im with state farm right now ive heard 50% pre-wreck value.
my car now is a 00 and just hit 90k at impact kinda strange but was clean title im the second owner with no accidents.
so i guess i will know tomorrow from estimates the damage done but i was thinking the 1/4 and door mainly would cost a bit to fix.

Not sure how helpful this will be, but anywho:

with my 02, it was 'totalled' last year in March. It needed a new rear bumper, 1 tail light, trunk lid, driver side rear quarter panel, and the trunk itself (like the lower shell metal tray or what have you).

This sneaky Russian repair guy bought it from Cali, fixed it with genuine Honda parts and sold it to me fully restored 2 months later.

I have state farm and I was in a wreck with my 350z. Value on it at the time was 19k. I had 12k in damages and still increasing and they hadn't decided to total it yet, so I'd just wait and see.

totaling at 40% of value? No friggin way. I'm sorry, but no company is going to total a car out when damages are 40% of value. That's insane. So that means a company would total a car worth 18k when damages are less than 9k? No way.

<----------Insurance adjuster.

Just wait and see how the process goes. If you've got major frame damage, theres a high likelihood they'll total it.

it's not that easy man. Hidden damage is usually 60%+ of the cost to repair most severe collisions.

Yeah I don't know - that's just what my sisters told me when they worked for Am Fam (they were both adjusters there). it might have been 50% though, last time I saw either of them was a looooong time ago.

My 94 Acura Legend became salvaged after theft. Damages inside the car were more than the car was worth. So they salvaged it, bought the car back for $700 and they cut me a check for $4500, fixed the damage myself which was less than 2 grand and used the rest for maintenance/update of the car. So if you're planning on keeping your car it won't matter, reselling it's another story.

Make sure you know your rights:

I would never want a vehicle that was in any sort of major accident. It's hard to get the frame rails, trunk lid, etc, etc back to 100% OEM spec. I think Repair facilities allow for an 1/8" off on areas of the car...

Either way, you're entitled to the fair market value before the car was damaged and since it has that "claim" on it, I'm sure you should be able to squeeze a couple grand out of the insurance company to compensate you for the LOSS OF VALUE b/c of such an incident...

Also, that cop is wrong, anytime you get rear-ended it's the other driver's fault; how could it of been your fault, and that ******** cop is NOT a judge, therefore what he says has no bearing on the case..

That is 100% completely untrue. If you're not an adjuster or lawyer, don't say things like this, it makes you look incredibly stupid.

If I pull out of a shopping plaza right in front of you, and you rear end me, it's NOT your fault, it's mine.

Or, say, You're in the right lane and I'm in the left lane. I'm slightly ahead of you, and I swerve right in front of you and slam on my brakes. Again, I'm at fault, even though you rear-ended me.

only if you can proof it, my mom got backed into at the gas station and the fwaker lied about it, everyone ends up paying for their own damage

If there's enough evidence, what the other guy says doesn't matter. And as I said in another thread here, police reports don't hold up in court unless the cop actually witnessed what happened. Otherwise, he's only 'reporting' what people told him happened.

Usually in cases where someone pulls in front of someone else, there's enough evidence to prove it, and sometimes there isn't. But again, you're never 100% at fault if you hit someone in the rear.

Dude that sucks .. I hate hearing stories of s2000s being hit, especially if it was not your fault! Whether it was your fault or not I hope you are able to sort it out with the insurance.
