Default Another one down, but not out. Got rear ended by large suv.

I was leaving town today, just backed out of my space, threw it into first and started moving forward when i got nailed by an suv who was backing out of a dead end parking lot. Here is the result.

The lady was really nice and sort of knew it was her fault because she said she didn't even see me. We wrote up accident reports and she left, i explained to the cop what exactly happened and he said I would be hearing back from them and insurance in a few days.

I know my car is a total wreck, i only bought it for $1500 back in october but dumped over $1500 in maintenance since then, i thought i had found a good deal as well.(Timing belt, waterpump, axles, brakes, coilovers, radiator, wheel bearings all done) I hope I am not screwed or both put at fault and left to fix our own vehicles. I'd like to just have insurance cut me a check but we both know its totalled and ill drive it for another 9 months to finish off college.

Anyone else had a similar situation and anyone offer any advice for batering with insurance

BTW we both had the same insurance companies, i only have liability but it was her fault so I shouldn't be concerned there.

most times in parking lots its shared liability unless she openly admitted to the cop it was her fault. you may get stuck paying for hers if she bitches enough to the insurance adjuster. I would call the company right away and open a claim against her policy.

Really, I never knew that. Some guy back into me in a parking lot and he knew right off the back he needed to pay up, guess he didn't know about this though.

I was in a similar situation, but not nearly as bad. I backed up a few feet until I realized the person behind was also backing up (I was moving first). I stopped and waited to see if the person backing up noticed me, but she didn't....them I felt the car jerk. The insurance co said even though I started backing up first and came to a complete stop, it was still 50/50. The reason was because I needed to honk to get their attention. The driver should have been looking back when backing up. Total bull

I filed an accident with insurance just now. They told me if she is at fault then they will pay to fix or total my car.

i hate to say this, but..
hope that they total it.
fixing rear quarter panel damage like that is a pain in the ***** and often times it will leave you with a trunk that leaks non-stop with possibly no fixes. Don't take it to a cheap shop for an estimate if you will be taking care of that, take it to one of those shops that won't do less than immaculate work and get the car totaled.

speaking from experience, i've owned two cars ( 1998 suzuki esteem & 1999 honda civic EX ) with gnarly rear end damage and tried to get it pulled out / fixed and always ended up with a flooded trunk no matter what.

your car may be different but i thought i'd just give you the heads up/

Good news for me, lady charged at fault and car is at the body shop in order for insurance to know what the extent of the damage is exactly. I'm getting it totalled if the price is right or keeping the car and getting a check to fix it(pocket) and calling it a day.

good to hear.. good luck.
if you chose to keep it.. make [freak]ing sure you know how they're gonna go about fixing it because a hit like that is complex to repair.

you shoulda seen the quotes ( and looks ) i got from guys when i went in to get estimates to fix my ****.
