you are asking honda-tech and not taking the manufactures word on this?

and the answer again, is yes, granted nothing is cracked/torn, which is exactly what you confirmed when i asked.

yes, because your word/answer isnt logic, especially coming from the "leader" manufacture!!!

you do realize that the gates/bov/all tial products are warrantied for life right? if there was a problem with it it would be taken care of for free...

which pertains to defects, problems etc that came from the factory, not a wastegate that was sold to a North Carolina shop, then found its way to Israel some time in a 3 year period, and on top of that, have a different spring in the unit (verified through images sent to us) than what it originally came with, which makes it clear the unit was opened at some point during the 3 years of circulation.

I can't just give you a new spring cup assembly because 3 years after the fact the diaphragm ends up being pinched, nor had you/anyone complained about the wastegate not functioning properly in those 3 years, which it would have.

I offered to take it in and fix it for you, you declined because of your location, I tried to find a shop near you that had spring cups in stock, no one did. So now we are at this point. I pointed out a free solution to the problem and you are refusing it, claiming it's not 'logical' even though the manufacture is telling you it will work and has been done time after time.

It seems you just want something for free

This is funny, because I opened my 44mm Gate for the first time the other day to put a new spring in it, and the diaphram was folded over itself over the area of about 3/4 of an inch, so I left the spring out and just tucked it in right and put the lid back on it to try to make it "re-form" itself and it still does it, but I have managed to get it up in there with a small screwdriver before I tightened the lid back down. I was having creep issues but I dont think this was the cause of it.

you have to run pressure through it, it won't form back on its own

Note the two white dings on the actuator top in this image under the TiAL Sport logo

you aquired the gate in Feb of 08' (Exif data) as per the image you sent me, so you are telling me that before you bought it from another person, used, you have documentation that it had never been opened? I have all the wastegates data right here, and the spring it was shipped with doesn't even come close to what was in the images, so yes, it was opened previously.

the 'Ya think' response does indicate you want something for free.

We warranty the parts for life when something we did goes wrong, not when something someone else did does, if this were the case, one could shoot at it with a rifle and say they want a new unit free of charge because their gate was shot!

this is also why we have videos on our website that show how to propperly assemble a wastegate.

dude I think Tial is telling you, the WG you have did not come with the spring you shown, meaning it was opened before you bought it by the previous owner and its out of his warranty requirements, from a business standpoint how do you expect him to replace that for free???? He replaces that for free and then he gets 100 calls from people all saying their diaphrams are all messed up and they want them replaced too.

I am not taking sides, but you are really bickering over a piece of rubber that costs how much? I know you are overseas but that is not anybody elses problem but yours. When building a car you have to always factor in overages in the cost estimate to build the car, this is going to have to be an unexpected cost for you.

Tial is an extremelt reputable company, and I highly doubt he is throwing the shaft at you because he does not feel like honoring his warranty, your claim is out of their warranty requirments, and you are trying to argue with him until he folds or someone comes out and says he is wrong, but dont hold your breath because I dont think its gonna happen.

Like I said mine is folded over too, and I never touched the internals on my WG, I am just dealing with it myself, not really worth the hassle. I tucked my Diaphram back in there while tightening it and I have no doubt if Tial says it will reform than it will reform.

ive had my doubts about "tial" on here in the past and although i dont agree with him on a particular matter, i do believe and know 100% that he is right to refuse you a warranty on something that you bought "2nd" hand, it seems he tried to help you out so that you dont have to buy a new diaphragm but you wont take his advice.... im sure you realize the cost of shipping over sea's but your fighting a losing battle here
