Odometer depends on VSS or Speedometer ?

Default Odometer depends on VSS or Speedometer ?

Some of you might already be familiar with this issue. The speedometer on the accord(sig) reads 5mph more than what the speed really is. So at 60mph its reading 55mph - (an unacceptable margin of error in the year two thousand and eight!)

However, the VSS as reported in the OBD scanner is correct. It reads exactly 55mph.

So my question is - does the odometer (total miles on car) depend on the input from VSS directly ? or is it derived from the speedometer ? Because if it depends on the VSS then atleast the odometer is correct, but if otherwise then there is a bigger problem. By an error margin of 8.33%, and at 106k miles, thats an error of almost 9k miles till date!!

The tires are Goodyear Assurance Tripletred and are of stock size but that shouldn't matter since the vss is correct anyway.

Anybody have a similar experience ? I have heard about the odometer class action lawsuit but I am not sure if this falls in that category or not.

First I want to figure out if the odometer is affected,
and if it is, then figure out how to go about getting this fixed!

what is the official/legal acceptable margin of error ? I mean there's got to be a law otherwise manufacturers, dealers, and warranty providers could have a field day with this!

Its not the speed difference but the error in the total miles on the car that bothers me the most.
