HT member ekk41 sold me bent wheels!

I bought some wheels, Racing Hart CPF's, from member ekk41. He claimed they were not bent but were minorly scratched and curbed. I was fine with the scratches and slight curbing and they did look fine as far as not being bent but after closer inspection, they were not sitting right. The lips are crooked. I asked him for a refund and well... read on.

I only put a straight edge to the most obvious one and you can see that the edge is curved. I trusted you when you said that they weren't bent and they are. Seller isn't honest. That's what I've gathered from the pm's. Come on dude, its a damn verbal agreement when you state the wheels DO NOT have any bends. Refund should be returned in full because of false claim.

First, you're dealing with used parts. Buyer beware. Its the buyers responsibility for looking at the product and making sure it is what he/she wants. The seller can state to the best of his/her knowledge of the product. That's it.
Once the product is out of the sellers hand, its sold as is. There are no warranties or refunds on this site unless the seller stated that in the thread. The seller should have stated sold as is in his thread, but in my opinion, its believed to be so considering he's not a retailer. He's selling USED parts.
The seller was gracious enough to refund part of the money. In my opinion, the buyer should take it and run. The seller does not have to refund anything.
I know how it feels to be lied to on HT and purchasing parts where the condition was not exactly as stated in the ad. I've been there.

Why doesn't he just deduct the 160 from the 1200 and give you 1040.
