In cali, the seller is responsible for smog. if he doesn't want to smog it, the car should be dirt cheap. it's hard to tell what need to be fixed without the smog results. the high mileage doesnt really matter. how the previous owners took care of the car matter.

This is not true at all. When purchasing a car from a private party, it is bought AS IS. And it is the buyer's responsibility to get it smogged. Even if he had it smogged the day before you bought it, you'd still have to take it again YOURSELF before the DMV will complete the title transfer.

This much IS true.
As far as to what's wrong with it - is it stock or modded? You do need the results to see why it didn't pass. At that mileage, if it's bone stock, it's probably either a faulty O2 sensor or a bad cat. If it's not stock, then it could be anything and it's probably not worth the hassle.

just get the price knocked down. i would expect that in an area like that with emission laws that would definately make the value go down...i would never pay that much for that many miles or that age. and for even being in that area...
i hate when people who are wrong try to correct me. the SELLLER is responsible for the smog check. a smog check is good for 90 days, meaning a person can transfer a title as many times as he wants for that 90 day period. damn 08
