Merry Christmas Right? look what santa got me!

ok so this is my 1998 GSR got it last summer loved it ever since... did nothin but ever take the best care of it, never even came close to losing control or wrecking it...never wrecked any of my cars..(KNOCK ON WOOD)..
UNTIL>> X MAS EVE>
me and my younger brother going to the mall to return something. We go to get off the exit and you have to make a left off the exit to go to the mall..with oncoming traffic you never get throu until like light changes 3 times, and traffic was really backed up to the beginning of the exit, SOO i get in the middle lane straight throu the intersection on a green light (pretty much no traffic) one explorer behind me...noone in front of me, and no one coming down the hill at me
>>start to go uphill and make a LEGAL U-TURN to come back down and make a right on red to head toward the mall.
SO i signal, downshift slow down to about 5-10mph and begin to make the u-turn just when the explorer behind me is not paying attention to me and pitt manuvers me pretty much... just nailed me behind the gas tank door and then again in front of the gas tank door.
Heres the damage.


As for the damage
-driver rear fender is obv. **** on.
-trunk wont open
-Rear L tire is about to pop from moving the car, fender scraped it pretty good.
older african american lady...gets out of her car says OMG NEVER BEEN IN A ACCIDENT BEFORE
! i was like ya me neither expletive. Cop comes he was cool at least he was like ya this is expletiveed up i love ur car..(hes gettin a tsx before the years over..) so he showed some love and wrote up the report.
I only have liability.
So im hoping this isnt my fault...Find on out Wed..? \Took it to a friends body shop in which is dad owns...Really reputable shop around here, and they are known to do really good work..
So i guess im just looking for some comments, advice, anything i should know before wed when i talk to the shop and insurance company...really kinda depressed before xmas and lose my car..anyone anything

rims are gun metal, and as for now not for sale bc they are the only set.
But serioulsy and suggestions on waht to tell the insurance company? body shop?
What to do with my car...options?

hm so you just downshifted did you like not touch your brakes? maybe thats why she slammed into you she didnt see brake lights and didnt know you were slowing down so thats going to suck if she uses that as a defense im pretty sure it will be your fault then.
no i know i touched my brakes bc i went through the intersection like 30 and went down to 2nd with braking...she couldnt use the fact taht it was a stick and say i didnt brake or she didnt see it could she? ( i dont think shes that smart...) bc she should be paying attention reguardless and notice oh **** im closing distance between this car... handsdown thou, she wasnt paying attention.

that seems like kinda a wierd spot to have damage if she was behind you...did you swing way out or what?? how fast do you think she was going thats alot more than a little bump
it doesn't sound like it was your fault, like you said, she hit as you where slowing down. In a accident cops get the first call, then insurance, next i would start looking for a good body shop. If you can still drive the car I would take it to get some estimates. Im not sure of the laws in your state but, in Florida you can choose any body shop you like. The insurance company will be able to recommend some but there not all ways the best, but cheapest for the insurance company, Ask around. Make sure you keep all your paper work and stay on the insurance company to make sure they get things done. Don't sttle for any aftermarket aprts if they don't fit well, if any are used. When they do the work it looks like you will defiantly need a new quarter panel. When they cut the old one off make sure the new one is lined up good alot of shops don't quite get it right. have them make sure there is no frame damage since you said you can not open the trunk. The color match is the next thing to watch for, but most reputable shops do a good job. That sucks man but, if there is any other damage to the car paint wise now would be a good time to replace it. good luck

its not your fault man. you were hit from behind. i work at Maaco an we do tons of insurence job just like this. your good man. youll get a good bit from her insurence company as long as its a name brand company and not some side road off tha wall insurence agency.

Man that blows, it seems that people forget to drive when the holidays arrive. You will get it fixed that cant be you fault if it was legal u-turn and you signaled. It sucks now but you will be double happy when you get you baby back with fresh parts and paint. If it was me i would not fix it. I would part it out. b/c once a car gets in a wreck and gets fixed it will not drive the same. I hear that from everyone, that been in your shoes. plus would that turn your clear title in to a slavage title? Just my 2 cents. Sorry it happen to you bro.

slavage is only if i fix it once they say its totaled...i know its not totaled as long as the frames not bent...they were going like twenty so i cant see the frame being bent...

ya it will show on car fax bc it went throu the police and insurance... so ya, it was a rear end so no motor damage to speak of... thing im worried about is when i find out whos fault it is, and frame damage.
well it really depends on what the lady told the cop....its basically your word vs hers. she can say that you didn't signal or slow down, and was making an unsafe turn....if thats the case you're expletiveed. but if she told the cop that she wasn't paying attnetion and admitted it then you're good...you just got to see her side of the story and what she tells her insurance.
that repair will cost a lot of money...my front bumper when it was smashed alone was 1400 with headlights was 2000. quarter panel area is a bitch since they have to pull it out, bondo, and a lot of patient body work on it to make it look good. i would see what insurance decides to do before thinking about it. if they're gonna pay for i, i would keep it if low miles, and interior is clean.

on a side note i was involved in a parking accident and i'm taking this guy to small claims court because he refuses to give me his insurance and refuses to pay for the $900 damage he did to my front bumper WHEN i just got it back from the body shop the day before. and it was exactly the same thing MY FRONT BUMPER...so my bumper was perfect for a day before being scratched up again...

Sorry to see/hear that happened man...A couple of things to keep in mind:
- It's 99% her fault...she was the one who rear-ended you, and is therefore automatically at fault. Granted you were turning, which is an instance where you'd be the one at fault, but that would only be the case if she was legally going in the other direction. Since she was behind you, she might get a ticket for following too closely and might get another one for causing an accident, but she's very likely to be the one at fault here, I don't see why she wouldn't be, in all fairness. She might turn around and bitch and moan and make **** up about what you did wrong or what you didn't do, in which case you just take it to court, but you should be good here.
- When writing the accident report, the cops will take statements from each party but they usually will make a determination as to who's at fault. From there, it goes to the insurance companies, who can (on a rare occasion) just be like wtf it isn't my client's fault we're not paying...at which point you'd need to either prove it to them whose fault it was based on the police report or threaten to take it to court.
- Insurance companies are never allowed, in any state, to tell you where you have to take your car, and this is by law. The letter of the law in this case states that they are ONLY allowed to suggest where to take your car, and therefore will just cut you a check for the appraised value of the repair, or of the car as a whole if it's totaled. Don't ever let an insurance company pull you around, and don't be afraid to get nasty with them if they start trying to short-change you.
My honest opinion is that they'll total the car...I kinda hate to say it, but the damage looks like there might be more underneath the skin. Take it to the nicest, most expensive shop you know of, and if you don't know of any, go to a BMW or Mercedes dealer and ask them where they send their cars for body work. The best thing you can do is get the highest repair estimate possible, then in your case take it to your friend's garage and have them do the work for cheaper...then you just pocket the rest of it.
If they total the car, you'll likely be able to buy it back for really really cheap (after they cut you a check for the value of the car...try to throw some receipts of aftermarket parts at them, see if they'll pay for them too), in which case you could buy another teg, transfer over whatever parts you want, and part out the rest...
I always thought that in instances like this, where someone else caused a good amount of damage to your car, that you shouldn't end up just as you were before the accident...you should be ahead, whether it's with pocketed money or more mods.
