Default I officially hate left turns.

After coming back from a great lunch with friends and tuning up my car with new spark plugs and a distributor cap, i decided that i needed to buy some glue sticks for my glue gun. At about 7:30 P.M. PT I was hit by a motorist while I was making a left turn.

I was waiting at the corner to make a left [in front of the crosswalk]. The light turned yellow then red and check to see if the cars stopped. What I saw was last few cars that tried to beat the light and I waited for them to beat it. A It appeared to safe, so I proceeded to execute the turn.

As I roll about five feet out, I all of a sudden here a screeching noise coming from outside my passenger window directed towards me. First instant thought before I look to see what it was was, "Aw ****." Then BOOM. Driver hits my passenger door.




We then proceed to the side of the street. First reaction initially was call the parents and tell them what had happened [I am only 17 years]. So i call them and they tell me they were headed over. I start to curse, however, before i get out i decide to get out, i say to myself, let's play it cool. Pray to God the other driver is ok and that we can settle this in a peaceful manner.

I get out of my car and ask the guy if he's ok. Turns out, he can't speak english. I'm there trying to remember how to ask someone how they are in spanish but i cant remember. He hands the phone to me and the person on the phone says that she (his sister) is coming.

My dad and my brother finally arrive at the scene. After we assure each other that we are ok, my brother starts taking pictures of the initial damage. [This becomes very useful]. My dad starts asking the guy if he has insurance or a license and the guy tells us in spanish he doesn't have a license nor insurance. STRIKE ONE.

After ten minutes, a random car pulls up and the man gets out of his car and asks, "Who's car is this (pointing to my silver civic)?" I immediately raise my hand and claim it, yet in my mind I'm terrified that the man is there to help the person who hit me. He then says, "OK. I saw everything. Heres my number. Call me if you need anything." I notice that he only spoke to me and I assume he is on my side.

Then the guys sister arrives after a half hour and my dad and the sister start doing standard procedure when you get into an accident. (Insurance, license, address etc.) When then ask why the man doesnt have a license and the sister replies, "Fine you want to know the truth? He's illegal. That's life. What are you going to do?" After that, the sister immediately says, "It is his fault that this happened; it was a yellow light"

Remember how i said to myself that i was going to play it cool? After that sentence, i got the "OH HELL NAW" reaction (in my mind of course) and start boiling up inside. So we get in a little debate (peaceful) and then my dad says, "Ok stop; this is why we have lawyers."

After the debate the lady TRIES to say that we need to say that she was driving the car in order to claim insurance from her company because her brother, apparently isn't insured. She continues to say that if we press charges against him that he will only be forced to pay 20$ a month and we wont be able to claim. (BS; I'm insured incase an uninsured driver hits me; my deductable is 250$. awesome right?) STRIKE TWO.

So we finish exchanging the last bits of information. As were about to leave, I see the man trying to rip off the corner of his bumper. He's an idiot; my whole passenger door is shaped and marked by the color of his bumper, from side to side. I try to take a video of him ripping it off from my phone, but it was too dark. STRIKE THREE. He's out.

I plan on telling the lawyer everything that I've explained here. I have no sympathy, empathy, apathy, and any other -PATHY's for these people. I'm very angry that my car has been hit, no more than a month after i got her. [Her birthday is the 15th] I'm religious and I know it's bad to have greed and anger in my heart. However, i want to cash in on this. My car is salvaged and i purchased it at a low price hoping to make it better and into my ideal first car. My brother said I can get my car repainted, my quarter panels, passenger door, fenders, side-skirt, and hub cap replaced.
I may also be able to see a chiropractor just for therapy.

All of that however is not my primary concern. My car is fucked. The passenger window is open and stuck because the motor was fucked up in the accident. My passenger door wont open [i have a coupe] and the paint transfer looks like i was speeding through a puddle of black paint.
I still have to go to school and work tomorrow. We'll see how that goes.

That was my day.

that blows dude, at least your first accident wasn't your fault. sounds like that lady was tryin to pull a fast one on you with the insurence and the illegal mexican. it would have been a strike out if the lady told me that i need to tell my insurence company she was driving and not the illegal. good luck you **** should be covered tho

that sucks...i was hit by a lady that claimed she had insurance...turns out she didnt and i had a 500 dollar deductible...my insurance sucks...efin illegals...

apathy is the lack of concern or interest.

so yes, what you have is apathy towards them.

anyway, nice story, same thing happened while i was in the car with a young lady, only difference was she was at fault, and she was very glad to have the illegal person with no license say it was no problem and pull off.

if you have to make a claim with your insurance, then you risk the chance of your rates going up. If she was willing to take the blame then i would've gladly let her falsify the police report, but that's me.

hopefully insurance laws are different where you are.

and from that picture you should be prepared to hear that the car is totaled.

Just because he is illegal doesn't make him immune. There was an illegal (of 10 years, with warrants) who killed an off duty officer on an '07 Gixxer (I ride a bike, so I am a little impartial) who is going to jail for a long time. Of course he did try to run, but some witnesses held him until the police got there.

You need to go to court, with witnesses (subpeona them) and don't have mercy. I am half-Mexican, but I was born here and have worked for the life that I have, and if you can't get insurance or are illegal, then go back. That is the reality of life. I hate to say it. Obviously he did something illegal, and he should pay for the consequences. You shouldn't get f*cked because he shouldn't be here.

no cops? that makes accidents so much more stress free. i got screwed over on my first accident when i was 17. ridiculous.

dont call no insurance, guilty or not your insurance can still go up, call the guys sister and tell them to fix the car, and to pay for the rental while its in the shop.
if you start threaten them with lawers it can be even worse to you, after first appearance he will know your name and where you live.
and dont be suprised to find some damage on your car later on.
trust me if its just the door, no big deal, i changed my door, w/lock in 2 hours. the silver door will not be hard to find either. charge him $600 and work on the car yourself.

First of all, your insurance will not go up if you are involved in an accident which is not your fault.
Second, if you tell them you are going to sue, that is not going to make it worse. They will state your name in court, but cannot by law give your address to the defendant, unless it is applicable to the case itself.
Third, if there were damage to your car within a given time period, that would be probable cause to warrant the other driver for investigation.

To the OP, you have nothing to worry about. No matter what happens, the driver is not immune from what happened. Even if the courts can't do anything to the driver, the owner of the vehicle can still be held responsible.

dont get me wrong, im not saying the bike driver is innocent, he is guilty, i just think it will be faster and less stress if you dont go through insurance.
insurance companies are profit corporations, they will be happy to agree with judge's desicion "partialy guilty" and raise your premiums.

I have now cooled off and i appreciate the comments/ concerns.

I honestly dont think the car is going to pronounced, "totalled." It is prefectly driveable [engine is fine tires are fine, just cosmetic damage from quarterpanel all the way to the fender]

Second, i thought about calling the police at first, but my first thought was to call the parents. It was my first accident. When my dad got there i asked if we should call the police, but he said, unless there's serious injury like bleeding or broken bones, or like gas leak, they wouldnt come. The only number i knew to call for police is 911. I tried calling 611 to get the non emergency number but i couldnt get it through there. There was an undercover cop passing by in a all black crown-vic but he didnt stop. So i figured if he doesnt stop, i doubt others would care.

As for calling insurance and reports: i have to file insurance. I'm pretty sure the damage is over 500$.

As for the lady and her brother i feel for her and i understand why she wants me to claim that she was the driver. But i dont want to falsify the report and then have the lie bite me in the *** later [she might say i didnt say that or the witness might say something else] I have to do what i have to do.

Everyone is ok. However, within the last hour i've started to feel soarness/stiffness in my neck. I'm going to try to see the chiropractor to see if it is serious or not.

Hopefully the car will be settled in quick manner.

I hope you're not talking about the same biker that I am. Because I am talking about a drunk Camero driver RUNNING OVER an off duty biker. Not only was the kid (26) off duty, he was on his sport bike rear ended by a drunk driver.

This was after the OZZFEST concert here in MI. I have no respect for drunk drivers, nor for illegals. I have done everything for myself, and for people to take advantage of the system as well as the tax-paying citizens of our state/country should be penalized.

I don't mean to sound harsh, but the illegal that tried to screw the OP should be punished. I'm not necessarily saying jail time (although he should), but at least pay restitution for the damages.

Damage does not have to affect how the car drives or performs in order to deem the car totalled.

Cosmetic damage on a car, especially an older (cheaper) car can very likely total the vehicle.

^I dont like the sound of that. If my car is deemed "totaled" does that give me any advantages or repercussions?

Will i still be able to drive my car?

Okay, if you report it to insurance and they decide it's totaled and that they're going to give you a payout for the car, then they will sell the car off at auction. The car would probably be sold to a scrap company for scrap metal or parts, such as my old car ('97 EX coupe) was sold to CoParts for $800 from my insurance company.

You will also be given a chance to buy the car back. Talk to your insurance company about this first.

If you buy the car back, it will have a totaled title. You might be able to rebuild and get it retitled as a rebuilt title (depending on state laws).

Not as far as your vehicle is concerned, that I know of. That is a state-by-state matter. You can always buy your car back from the insurance company. As far as personal injuries goes, that is a different story. I would hate for you to go after the person for monetary gains when you are perfectly fine and get screwed. If you are really injured, game on, but please don't pretend.

Oh, and in some states, it is illegal to NOT call the cops when you are involved in an accident, even if it is single-vehicle. So don't try to use that as any kind of excuse. You can still get in trouble.

yup first thing i would of done in this case was call the police and filed a report.

then i would of called my parents.

of course this only applies if it wasnt your fault which it wasnt
