rough day
went into the background for a bit but today was just not my day.... got into a car accident while working. Thankfully, (I suppose) she got the ticket (I'm like a ticket away from lic suspension) it was her fault and there were no injuries other than a bruise from the seatbelt, but at the same time I think my car is totaled or at least thats what i'm hoping for at this point. She ended up hitting the right front corner of the passenger side seat. The tire shreaded rims all bent, ball joints and tie rod ends broke.. couldn't even open the passenger side door because the paneling's all bent (I don't know if it was the frame itself bent or not, but the headlight got smooshed in as well as the corner of the impact bar got bent and I believe I seen part of the frame... I don't know... just at this point I pick up the rental car tomorrow and who know's before long I have my car back or a new car (even tho mine was only a yr old, just bought it back last Aug actually lol) I kind of wish I took pictures tho... but I do have a question in all this rambling..
Just curious on the "totaled" part, if the insurance claim adjuster comes back thats it totaled, how does that work out with the old car and a new car as far as getting money. I did have a lease on mine so do I get the old one paid off as well as a new one (that'd be nice lol) or would I just get the old one paid off and then I can go look for a new one, free of the leins from before?

You would get whatever they "value" your car at. So they could in fatc give you less than you owe which means that you would have to cover the difference and get a new car. On the other hand they can give you more than you owe in which case you can put that towards something new. They way its described in your post I would say that its probably not totalled. But without pics who really knows. Godd luck either way.
my neck would start hurting along with my back... she wont pay a dime its all her insurance that will deal with it... you pay so much per year to these insurance companies and when its time for them to help in a situation like this they screw you any way they can....
thats just my 2 cents.
oh and how many air bags went off if any?

I've had a few junkers in my day before my 06 civic so I had to learn a few things here and there that deals w/them :D
and sooner or later me and one of my best friends are going to build an old mustang from ground (just the shell) up which is going to be SWEET cuz I'll even be out working on the car its a dream of mine and its' going to be an all show car when its done so that way it's in mint condition when we're done with it :D

your insurance will pay for the depreciated value of the car, then the gap coverage will pay off the rest. Then its up to you as to what you go buy or lease. Since you leased the car the laws and the way it works may be different, but not sure. Since you had a lease, if theres a contract involved you might have to lease another to fulfill the contract, but like i said i dont know the rules when it comes to a lease.
got the estimate.... $4650 in body shop and mechanical repairs
and its not considered totalled... but I believe its going to come down to the salvage value for before and after this accident considering it's already been in one before (that one found to be my fault) this one not... still keeping fingers crossed.... should have pics hopefully tomorrow I can pick up the set.

Altho it's getting resolved and my question was answered thought I'd at least show the pics that I got.... a lot of the shop job lies underneath in the axle as that whole area is being rebuilt.
O I also got a letter from my insurance adjuster who sent a letter on my behalf to get my deductible back so I won't have to pay for that... so I should be getting that check soon I hope

She would be financially responsible for the portion that the insurance didn't cover, at least when I was involved in a similar situation the at fault party had to pay for the difference. GAP is always advisable when buying a new car. If you have under insured coverage that could help you although I don't have any experience with UI coverage and this situation. Call your own insurance company, they will help you.
Also I would definitely ask about diminished value payment !!!!

Since it is being repaired, would you have to pay some money at the end of the lease? This doesn't seem like it may qualify as reasonable wear and tear. You may want to ask your adjuster about it while the claim is still open.
Ed thats an interesting point, I'll bring that up when I go pick up my car next week but that probaly falls under the whole "dimished value payment Kidnkorner was talking about.
Altho with my lease as long as say I buy the car, buy a newer car (2010) or lease the next car from the same dealership then I won't have to pay a dime for my extra miles and the other stuff but just to be on the safe side I'll ask about this stuff.
