so I'm pullgin outa jack in the box... after a party.. and it's the one along montague on friday... but neway.. I pull onto 880 a cop pulls me over for no front plate seems all G... and then he says I have a suspended license for failing to show up on a court date?... I went to my only court date and I have 3 other thigs pending 2 fix its and a traffic school which I all got delayed and they are to be completed soon. So I know nothing of my suspended license and according to my friends I shoudl have received multiple letter stating my DL is suspended of which I have seen nothing...so they tow my car and drop me and my friend off at a gas station I asked if my friend coudl drive and he said.. nope.. law says suspended license and the car shall be towed... so I'm liek wtf... but ne way I think what happend is that the officer in my traffic misdeamenor that I went to court for, well he changed the date of my court date and I went to the new date maybe he didn't update someon and they thought i was supposed to go to the old date and since I didn't go to that date they suspended my DL?...

well basically if this is all a **** up because someone dropped the ball or theirs a failer to communicate, then I'm gogin to sue whoever is responsible... either the DMV or CHP if it is what I htink it is. Think I got a case if this is what happend ?.... cus it's a fat waste of my time and it's their responsibility to file their **** not mine.. so they aren't doign their job and what not. and they towed my ITR.. someon head needs to roll for this

yes, i hear that. however, that situation is very much fawked up, hope you have $$ to get your car out, because it won't be cheap. You better go there bright and early tomorrow morning because it'll cost for having to stay over there over night, PLUS, it's an ITR in a towing yard, need i say more?

 

if theres ne damage or nethign is missing.. I'm gonna sue for a lot more....

 

you won't win in court...the officer's responsibility was to tow the car as it showed the license suspended...

go ahead and try w/ the courts, but at best, you'll get cleared of the discrepancy and they may even reimburse you for the towing

Courts never reimburse for towing. Neither will DMV. If your car is towed, they will both tell you that it was your fault for not following up... even if there is no reason why you would think that you had to. It sucks... I know firsthand

 

then I will sue.. it is the courts responsibility to turn the paper work in .. I went to my court date and have the papers to prove it.. thas not my bad thas their bad for not getting their **** strait

stop nitpicking.

 

Just get your ITR out of the towing yard, and find out whoever messed up (assuming you did you did everything you could with the CHP to take care of whatever situation that is still in effect obviously), and let them know the situation.

 

what I woudl liek to do actually is, that isf it is in fact the fault of the CHP or because someon made an error in filing my reckless driving papers.. then I wanna make a deal that I won't sue them if they drop my reckless ticket.. if not then I will sue....

 

They'll most likely laugh at you. However if someone indeed dropped the ball, they should be responsible. Although it will most likely not be worth the effort to pursue.
