I got rear ended today...
I asked the cop about getting my car fixed and she told me that I needed to contact my insurance company and have them take it up with the other guys insurance company. Do I have to do this, or can I just call the other guys insurance company, with a copy of the police report and file a claim with them that way? Or does my insurance company have to handle it?
if youre positive its the other dudes fault, contact his insurance company first. if you contact yours, theyll want you to file a claim, which COULD increase your rates.

I am 100% sure that it was his fault for a few reasons...
1) I was rear ended (99.9% of the time the rear ender is at fault)
2) I didn't have my current insurance card on me and the cop told me that she was only going to write me a warning for no proof of insurance b/c I was the victim and she was writing the other guy an actual citation b/c he didn't have current proof of insurance either. We both had our previous years proof.
