Got court date, what should I say?

hey guys, i know this could be related to off-topic discussions but I thought that in motorcycles section i can get more direct responces.

I got court on the 15th for 3 violations: Speed beyond reasonable, driving on the opposite side, and illegal passing.

The truth is what happened is that I got a hater cop because what really happened was that my buddy and i were riding, came up from the back on an old lady who was going barely the speed limit. My buddy went around her and so did I once we got a nice stretch. Unfortunately, with my luck, when I went around a cop saw me. Anyway, I thought that would be no biggie so I continues riding as we crossed ways. 5 minutes down the road I'm chilling on the red light with my buddy and cop flies up from behind me. gives me 3 tickets and even mentioned something how I'm lucky i'm not getting locked up for trying to evade the law. So anyway, I'm going to court and I'm planning on pleading guilty with explanation. I am guilty of passing the lady and I admit it was stupid of me. I would have never done that if I had known where the hell we are going cuz i was just following my friend. But I wasnt speeding nor was I driving on the opposite side of the road. I know judge is not going to listen to the whole story so what should I say to make it short and to the point?

Hell no get a lawyer. My friend had something very very similar happen to him about a year ago in Vermont. They raped him so bad. In his case he had two other guys riding with him and all of them got 4 tickets. Well the other two guys got lawyers and went back to Vermont to fight the tickets in court while my boy didnt. They got all there charges dropped while my boy got 4 points and fined 1250 bux. GET A LAWYER!!!!

The bottom line is that you got busted - so there's not a whole lot of leeway to get out of it. Unless the person you passed was going way under the speedlimit, or was doing something unsafe (weaving, swerving, etc) then its going to be very hard to justify.

Might want to talk to a few traffic lawyers.

"Was going barely the speed limit" Not to be an *** because I myself speed all the time, but the speed limit is just that, a limit. I don't know how it is where you are from but I never had an opportunity to explain to the judge what happened. It was either guilty or not guilty and on to the next person. I dont know if you have them where you are from but out here there are advertisements all over the place for places that can get your tickets dropped down to parking tickets with a reduced fine and you dont even have to go to court or traffic school. I would suggest looking into that. It is very likely the judge will not be interested in what you have to say. Think about it, all day long he has to listen to peoples excuses for breaking the law. For the two tickets i ever got i paid $250 dollars for a lawyer, and he made the tickets go away.
Maybe if you're lucky you can get a defferal and take a class or something.
In the future, if your friend decides to do something stupid, boycott his *** and dont' copy him. I've ridden with people all the time that go and do stupid ****, if you just dont' do what they do, they realize they're not impressing anyone, slow down, and let you catch up.

I'm getting a lawyer and going in on Wed. I'll let ya all know how it turns out. Wish me luck.

P.S. Its 70 degrees in MD, the ultimate riding weather! I might even ride to court lol

The times I have fought a ticket, I represented myself, but you have to treat it like a trial, which it is. you have to set up with an opening statement that lays out what you plan of proving during the trial, prove this during the trial and then do a closing statement, it really is pretty fun... but you have to have proof beyond a reasonable doubt otherwise your SOL. the biggest thing to remember is that the officer is ONLY A WITNESS, that is it(this is california law). you can discredit this witness, poke holes in his ability to do his job in alignment with a manufacturers stated equiptment use, etc. I dont know the particulars of your case

fyi.. in california.. if your gonna pass a car.. stay on your side of the lane and pass him slowly. That is completely legal because in california.. motorcycles are allowed to share lanes with cars.

what about 30 in a 60? I wouldn't consider that safe

if all you did was pass the lady in a non passing zone .... the only citation i'd think you'd get would be illegal passing in a non passing zone, because a) to pass a car, you will obviously have to speed up to over take it .... and b) to pass a car you're obviously going to have to drive in an oncoming lane to do so.

was it a double yellow line? you shouldn't have gotten 3 citations.

sorry to hear that, like eveyone else said get a lawyer.. if lawyers around your area is expensive.. a friend of mine told about Pre-Paid Legal Serivce, try them if they can help?.. hope it goes well

Ok so I had my court today and I will tell u staright up I got raped without any vaseline. To those who want more details please read below:

So I called one lawyer who said that he's gonna charge me flat fee of $500 dollars no matter what. If the cop doesnt show, or if I get raped, basically no matter what its $500. I thanked him nicely and told him to go F%^& himself.
Called another lawyer and told him about my situation. He said: "I charge 250, but I am unable to go with u on wed", but here is what he told me to do. He said: "go alone, dont give any excuses, just explain what happened and see what happens. If you get nailed we will file an appeal and I will help you". So I went by myself. Dressed up nicely, plead guilty with explanation. Told him that I wasnt speeding, nor was I driving on the opposite side of the road. I admitted to passing the old hag and told him I was sorry. He looked at me and gave me probation b4 judgement for the only thing I plead guilty for, which was passing, BUT I still had to pay the full fine. As far as other tickets, for speeding and opposite lane driving, he nailed me full speed. 4 pts and 250 fine. He didnt really let me finish even, seemed irritated and angry. Told me if there is something that i dont like about his decision I can appeal and I was like u bet ur *** I will! So I called the good lawyer back and told him about the whole thing. He said, we appeal and get their ***. Dont worry. SO we'll see
