my EG was hit in the rear bumper before but the previous owner(family friend) said there was no frame damage, but the metal part under the spare tire there are some minor cracks filled in with what looks to be tar or some thick black substand, and one crack thats an actually crack that I can stick a knife through .. is that part of the frame/count as frame damage?

well it's a unibody so it's all part of the frame :-\, so probably..

It rides smooth, right?

It could be bent a little, though :-\
