Contributing to the delinquency of a minor....
Last night a few friends threw me an early bday/going away party here in Va. There was quite a few people here...the police came due to a noise violation to start with. There was 1 minor here that showed up drunk from a kegger he'd attended before my place. I had not served him ANY alcohol AT ALL. This minor had come outside on my balcony while I was out smoking a cigarette and sat down and was talking to me. I didn't realize that he'd been drinking already. I set down my beer to come in the house and check on my kids who were asleep in the other room. Next thing you know, the police are here, someone came in the room to tell me and I walk out and am now being charged for contributing to the delinquency of a minor. The kid apparently picked up my beer while I was inside...when the police walked into the house, he had it in his hand and the police saw...The kid blew a .30 or something, but it was way above the adult level. I was planning on leaving to go to CA. Next Friday. I'm attending court Monday for my pretrial, but I didn't even do anything wrong. Any advice on what to do in court Monday? I know I'll probably have to pay a fine, but now I'm worried about CPS taking my kids and me going to jail and being charged with a felony...How much will this fine run and what do I do or say in court to NOT be charged?

not sure what the fine is, i would be more worried about you bringing that kid into court to testify and him lying about already being drunk prior to arriving to your house.
the more witnesses you have that will support you as far as not giving this kid alcohol or have it present for him to obtain you will be ok.
BUT.... who leaves a can of beer next to any kid??? so that part you may be screwed on...
