Default I have no car.

CLIFFS: Uninsured woman in 00' v6ux stang vert lost control on freeway, destroyed entire drivers side of my hatch. It's totalled.

Was heading down the 91S into San Diego 8am traffic, left lane. Stang was in front of me. Looked as if her rear, drivers tire blew up. She instantly went into a fishtail, went off into the center field at full speed, swung around, came back into traffic and her front end hit my entire drivers side square on, at what seemed around 60mph. Who knows...

I was sent into a 180 and was now going backwards at half speed. Put it into neutral and coasted into the center field area. Had to climb out the other side .

When she hit me, the side of the car caved in and hit my knee and of course jerked my neck.. so I'm going to see a doc first thing. Just didn't have the time today was trying to find a car, been talking to lawyers and insurance people all day.

I know you can't squeeze water from a rock, but I'm not letting her get away with this and going to try and nail her for EVERYTHING I possibly can.

This might be a fucked up situation, but America isn't what it used to be.
You have every right to sue because she had no insurance, BUT, the question is whether she has money or not.
If she has no money, the most she will get is to go to jail.
I can't see anything more
best of luck

first and foremost before suing. find out what kind of assets she owns that could be liquidated by the court before taking her to court. You can do this through a PI. Try to settle it out of court if she's up to it and has money. If not, take her to court and present all the documents you can on what she owns and how you feel you should be compensated. Also remember small claims court has a limit of 5k, so being that u want more, go for a limited civil case under tort where the limit is 25k. good luck with your case

Sorry to hear, hope to hear good news from follow ups in this thread.

Unrelated, but reading the last paragraph of your initial post while looking at your avatar is kind of funny.

If she doesnt have money now, you can sue her so she has to pay you a set amount each month untill she pays you off. You might be able to take her house, anything that helps you get her money. In order for you to get the most you will need a good lawyer.
