Steve, whom Josh works for, already sent me an e-mail regarding the theft of my pictures by Josh claiming it was him.
Second, Josh I will have my lawyer send you an invoice for the pictures that you infringed on my copyright for. Oh yes, you will now owe me for "your" pics that you have on your PC.
The pic posted in the General forum has drawn much attention, so much so that I have been contacted by lots of people, thanks all!
The pic is not even from Buttonwillow, see the Palm tree, do you think Palm Trees grow in Bakersfield?? You wouldn't know Josh, since you live in Utah.....

Correct me if im wrong, but, isnt the rider the ONLY person the photog can sell the pics to unless the rider signed a model release form. Part of my job description is to photograpg girls for my club. I cant do **** with them unless they sign a release. Just wondering if that would apply with something like this

I just hope this gets resolved in a quick and just manner.
Boosted: As motorcycle riders have leathers and helmets on they are not able to tell who is who like in a portrait of an individual, so model releases are not generally used in the practice for personal use. For magazine and commercial it is a different story.

from 15-22 i raced BMX religiously... don't have much time to ride now. there was a company called action photography, or something, i could be way off... that would come to the nationals or even some local events to take pictures of riders and sell them to the riders. whether or not you can see the rider's face and distinguish who they are, the images are still sole property of the photographer. the rider knew he was there and if he didn't want pics taken of him, he would have to state that to the photographer or ask them to delete them if already taken. in this case, he wants the picture, but doesn't want to pay for it.

no, if its in public you can sell the pic, the release is more of a formality of stupidity via happy go lucky people wanting to sue.

There was an internet statement about having stolen media. It was a statement made on an automotive web forum, not the most reliable of a 'confession', and media gets stolen all the time online. It seems that the only folks really able to draw out the matter are big-buck MPAA and RIAA co-ops.
But really, I think it would be amazingly cool to serve a subpeona to this gentleman from your district court. No matter the verdict, if you ask me, justice is served in the trip over
