Technically, people do "own" the pictures they take, and using someone else's photos to sell a similar product is a little deceptive.
If nothing else, the offender opens himself up to charges of fraud when people notice that the pictures belong to someone else.
I understand why the guy did it, and I am sure he will say that he did not mean for the pictures to be a representation of the actual product, but he really should have taken his own pictures.
