minor car accident

Default minor car accident

while driving on Route 3 East, NJ, there was a little traffic, I slowed down, then all of the sudden, this mid-aged lady in a old model Nissan Sentra, rear end me, I stopped, she was in little panicing , then she backed up a little, and boom, hit me once More....

I was like WTF.... I pulled to the side alone with her. I got out of my car, she got out of hers, saying, "Why did u backed up?"

I was like, are u smoking crack?? (She was actually smoking at that time)

I was going 10 mph, how do I do reverse? she then said look, it's very minor, just let it go.. I was like, there are heavy scratches on there.. either u give me the insurance info, or I am calling the cops.

2 mins later, cops came, and she then again, trying to argue.. I was so pissed, and said "Stop making up lies, you didn't stop in time and hit me.."

the cop then told us to stop arguing, and go back to the cars. 15 mins later, he came over and hand me a card, told me to picked up the report in 2 days...

I didn't get any of her info except for the license plate...

what should i do at this point?

dunno, I'm guessing your insurance company knows? Did the officer tell you who was at fault in his opinion? Or do you have to wait for the report?

that bitch keep on denying.. never seen such an annoying person before..

I must wait for the report.

Is there a law saying if u rear end someone, it's always 100% your fault?

or did that law changed in NJ, any ideas?

Never 100%, but most of the time. Let the insurance adjusters handle it, thats what you pay em for.

I know whenever you are rear ended its almost always the fault of the person who rear ended you. I dont think you have too much to worry about I have been rear ended two times and one of the times by an old lady who tried to make up a bunch of BS but she still got the ticket. The only thing that seems weird to me is why the cops did not have the two of you exchange information. Good luck.

the police got both of our info, and told me to picked up the report in 2 days. all info will be on there...

Ya, it pisses me off when people try to make up BS.

You are 10% at fault just for being in the wrong place at the wrong time, unfortunately, but I'm sure you have nothing to worry about -- just let the insurance company handle it.

Get the Police report as soon as you can and claim the accident with your insurance company. They will take care of it from there and take statements from both sides. The claim will most likely be in your favor because it was a rear-end collision. Presumably she has insurance so expect a claim adjuster to inspect your car and give an estimate or a check, and possible a rental. Hope this helps, I've had to deal with problems like this myself. If not sue her!

problem is i have 1000 deductible, very sure the damage will be less than that. Geico told me if Geico isn't paying out money, they won't bother fighting for it.

so basically i am on my own, i can file claim to her insurance, but if she deny it, I am screwed..

In that case try and get her info (from the DMV if you have th tag#) and call her and try to settle it without the insurance company. She may like that idea so her rates don't go up. Get a quote for the repair, and call her. DON'T tell her you want to avoid claiming it because your deductible is high. If you have the Police report and it says she is at fault thats even better.

I've been through this plenty of times and it also depends on your insurance. If you're 100% sure it's her fault, you might have to file a claim with yours and then they'll go after her insurance company.

I rearended this a$$hole a few years ago after he made a u-turn in front of me. His insurance denied my claim and told me to fugg off. I called mine and a few months later they got it all settled and I was happy.

They'll try to drag this out as long as possible, just learn how to play the waiting game if it comes to this. It's still early, so first you need to contact your insurance and let them know what happened, but not file a claim yet. You should have gotten all her insurance info at the accident and filed a claim that day with her people.

What I would do first is get her insurance info then file a claim. See what they have to and move forward from there. Let us know how it goes and we'll walk you through the rest of it.

They'll also make you take a recorded statement. Make sure you go over the accident step by step with a friend to prevent you from incriminating yourself. Everything you say has to show:
1. You were in control of YOUR lane.
2. You were going forward and following traffic carefully due to the build up of traffic.
3. You had no distractions such as music, cell phone, smoking, etc.
4. She hit you, then hit you again while smoking a cig and who knows what else.
5. You asked her for her info calm and collected, but she refused to give it to you.
6. She lied about the accident from the beginning and is still lying about it.

If you suspect she was on the phone while she hit you, ask them to get a record of her phone bill

good advise Jowee.

Now I would just call her insurance Co up if the report is 100% in your favor and ask them to pay. Be sure to get two or three estimates from local body shops, be ready to fax them out ASAP if the woman's Ins asks.

If the ladies' Ins is cool they will just send you a check with out any headaches. I did that once back in '97 and the Ins Co for U-Haul just paid without any problems. I got $1800 from them for the damage to my Jeep from a Drunk Driver in a U-Haul.

No need to contact your Ins Co. if it's her fault. Just call up and play the waiting game. If they give you a hard time then ask to speak to a supervisor and ask what's the hold up.

Your only hiding it IF the cops said the guy who got it in the *** was at fault and don't tell. Other wise, no big deal.

I seen some idiot woman in a beetle rear end some guy in a Camaro...the Camaro driver stops me and says that I rear ended her, causing her to fly into the Camaro.

WTF, some of those drivers make the stupidest most unbelievable unintelligent excuses ever.

Like above, I don't think you have much to worry about, since you were the one that got rear ended.
