Have a problem guys.
Alright heres the situation i bought a 02' F4i about 1 1/2 years ago and the dude refuses to send the title ( I paid cash ). Apperently he had a lean and didnt use my money to pay it off. My question is what shoud i do. A) wait 11 months for him to finish the lean B) Sue the ever loving crap out of him or C) I don't have a C thats where i need help what else can i do.

doesnt registration of the bike in your name require a proof of sale? registration should be proof enough, no?

If you have a bill of sale or documents that he sold you the bike and you paid for it take him to court. Cm'on guys do you seriously think he bought the bike knowing the dude wasn't gonna give him the title? If the loan was local I would've went with him and made sure he paid the money on that loan. I'm in kindof the opposite situation now, I sold a dude a car and I knew him, well thought I did anyways and he gave me a down payment and was gonna pay the rest next week, he didn't and said the week after, he paid that week but the f*cker still owes me some of it and everytime I go back he doesn't give me a straight answer. Well I had friends go with me when I sold it and we signed an agreement saying that he would receive the title when I get all the money, I still have the title and it's still in my name so I'm just gonna go over there and hook a chain up to her and drag the **** home. Enough of my venting but anyways I always hate it when me or someone else gets screwed because of people like these.
Do you have the thing registered? Thought you neede a signed title to register a bike.

I had the same problem when I bought my bike, but it was just misconmunication, took me an extra week and two <U>EXTRA</U> trips to Phoenix to get it but I did. Definately get the title ASAP!

Well First I do have a bill of sale, I'm not that stupid. Second, 1 month turned into 6, 6 turned into 8 ect. ect. Untill its 1 1/2 later. I havent sued him cause it WILL send him to prison, Selling something you have a lean on is a serious offence - jail time. He was a real nice guy to he just dident have his **** straight so, i dont know.
your best option is to really get down to business with him (in person--not on the phone) and plan a solution to this. get everything in writing, then get it notarized just in case he jumps ship on you again.. surely there's a way to get your title.

least thats how it is in PA, dunno about VA.
my mom sees this **** all the time, either the person is scamin or just doesnt understand the laws, either way she sends um out the door.
not too beet a dead horse, but u never should have shown him any money till he gave up the title (not tryin to critisize, just sayin).....
and prolly shoulda taken care the problem a lot sooner....u'd have been in some deep dodo if u got pulled over on the bike....... i know what ya mean about a month turnin into 6 though

First off it's not illegal for him to sell you the bike because he doesn't have the title. Technically he has the title, he is the owner of the bike but since there is a loan on the bike the loan institution is the leinholder and has the title. Also has he been paying insurance on the bike while you've had it? In va if there is a loan on a vehicle there has to be comprehensive and collision on that vehicle. That protects the bank so they get they're money back if it gets totalled or whatnot. Now if he doesn't have insurance on the bike just call up the bank and tell them that he doesn't have insurance, hell you could call the dmv and tell them too. What should've happened is that you went with him to wherever the title is and watched him pay it off and then you get the title. I seriously dought that this will send him to jail, now he might have to pay a large sum of a fine. I'd say do whatever it takes to get that title, you have a bill of sale so quit looking at it and go put it to use.

It is my understanding that just because he sold the bike to you, doesn't mean that the lien holder loses their claim to that vehicle. So if you sue him and send him to jail, you might just end up having to pay off the loan on the bike, or give the bike back to the lender.
You're in a pretty bad legal situation, and only one who can give you straight advice is a lawyer. Go get one.

I cant talk to him face to face he lives in NC. I really dont want to sue him he was a nice guy just with big problems. I don't know im just gonna give him my weekly call and give him an ultimatum. Thanks for your help H-Ter's
