Default Should i GIVE a REFUND?? - need advice

I posted an Apexi N1 exhaust for sale recently on here, Team-integra, and EBAY

when it didnt sell, i kinda gave up-
this guy emails me out of the blue asking if i still have it for sale, i say yes and we agree on a price.

AFTER WHICH he asks if i have pics-- keep in mind- HE FOUND ME - so he must have seen the pics online before where i had the ads and auctions listed..... I told him pics were on online forums here and T-I.net

HE found them and agreed - sent me a paypal---

now that he has recieved the exhaust he says he didn't realize the damage was THAT BAD of condition. and is asking for his money back---
I dont think i should give it back but what do you guys think....I am an honest guy, and have 100% feedback so far everywhere including here and dont want to get bashed...

here is my reasoning for not giving a refund - tell me what you guys think:
1) He approached me for the exhaust
2) he already saw the pics
3) I'm moving and needed to get rid of this so i dont have to ship it around again anyway.-- why should i take a loss...........

if the pic clearly showed the damage, then no, he should've seen the damage and expected it. no refund

i think he should pay the shipping back to you and then you can just sell it again thats what i would do

he's willing to eat the shiiping back but ill have lost the shipping TO him on the first go....

i just dont see why i should have to do this - i dont want the exhaust- no one else wanted it when I was selling and it took too long- i cant have this on my hands again... i was so happy to see it go....

u would refund the money if he paid for S&H ..

put urself in his shoes... thats the right thing to do..

send him a pair of glasses, lol jk. but if he saw the pictures before buying he shouldnt be complaining now that he received the exhaust. if he was in doubt he should have asked for more pics.

Pics show the damage, he knew what he was getting himself into when he saw the pictures. No refund.

If he pays for shipping I dont see why you wouldnt.
But it is pretty obvious how it is scratched....

just for information - here is the email i got today...


"Wow I just got the exhaust today. I need a REFUND big time. I did not even open the mide pipe box has yet. I had no idea the axle back was in that bad of condition at all. Please refund my $280 to me and i will ship back your exhaust i take the hit for the shipping. ........etc etc etc..... Please i need my money back. thanks"


I deleted his number that he left for contact just to be polite-- thats where the etc is -- but the rest is quoted....

i really dont want to have to deal with it anymore-
no one really wanted to buy it except for this guy-

everyone was lowballing and offering like 100 bux for this- but he gave a reasonable offer-- PLUS im moving in less than a month - i dont want to have to load this in a uhaul to carry across three states......

am i just being selfish?

I think that if he is willing to pay to ship it back at his own cost then it is only fair to refund the money minus the cost it took to ship it to him. But I also think that you have every right not to refund the money.....the damage seems to be obvious.

I looked at the pics. The damage is obvious. He knew what he was buying. For all you know he could be BS'n cuz he changed his mind. A deal is a deal and u didnt hide anything. NO REFUND.

but then the other side of me wants to say no refunds.. pics were up... so i'd go with the no refunds

You explained the damage, showed pictures and he agreed to buy. You have every right to not give him a refund.

dude, the scratch is VERY obvious and I think he has a pretty darn good idea what it is like... (the scratch is on the bottom anyways...for god's sake, it's a freakin' exhaust! no one is going to check out the BOTTOM of the exhaust)

I agree.

It's not like you were purposely hiding the dents. The pics show the damage clearly.

My vote is for no refund. I'm sick of people changing their minds after the fact and then expecting the world to bend to their way. Some people just need to accept the choices THEY make. Sure it sucks that he got something that he decided he doesn't want, but why should you have to change your mind. There's a reason all major retail outlets don't accept returns on open-box items they sell. If enough people can tell the damage, then there's no reason he shouldn't be able to. He bought it, he keeps it. End of story.


Sorry to vent... just hit a little home for me.
