Small Claims Help???

Default Small Claims Help???

I'm sueing an ex friend (Ex friend meaning he was untill now) for rear ending my car like 2 weeks ago. I gave him the 2 weeks to figure something out for money. He hasn't done **** to figure it out. I had it estimated at $2,600-$2,900 in damage. It was in front of his house, so it's considerd private property. so a police report wouldn't work. but the night he did it i had him sign a pice of paper saying he was going to pay for the full dameges to my car. I also had to wittnesses see and sign the paper.

He also has 2 warrents, no inssurance, and no drivers license.
So my question's are:

1. Will i win this case?

2. Will i get my money right away?

1. yes you will win.

2. no you will not get paid instantly, and you will have to either higher a lawyer or have a collection agency collect the funds. and they normally take 50% of the judgement. and the lawyers take a percentage plus their court time.


and if the person has no money in the bank, no job, no physical property in his name. then you will have to sit around for the next 10 years trying to collect the funds.

after ten years and no money you can reinstate the judgement for another 10 years..

hopefully in the next 20 years he will have some sort of property in his name.

if he has a job you have to have a lawyer go to court to have his paychecks held and a certain percetage is taken out every pay day.


no job no money for you..

depending on the cost of those warrants (and if they are arrest warrants or just money warrants) you can always go to your local police department and say i know someone who has multiple warrants. and they will decide if they need to go arrest him or not.

i figure a back stab for a back stab.. an eye for an eye..

why didny u just file a claim against his insurance? that way youd get ur car fixed in a week or so [depending on what happened] and youd get a rental car

Apparently some of us need to go back to 2nd grade, because you obviously didn't read how his ex-friend who rear-ended him DOESN'T have insurance.

I would say go through the courts man, may take a while but you'll hopefully get everything.

i would get my car fixed, but i only have liability. what pisses me off is that he isn't even trying to find a job or get some money to fix this. he doesn't think im sueing him.
