Default State ref ticket! positive input always a +

Hi,

THe other day i was driving to San jose, and i was on the freeway and got pulled over going 80mph on the freeway he pulled me off the freeway off the great mall exit, he asks me how fast im going and then to pop my hood. SO i do because i igure if i say no he will get suspicious (i shoulda said no) my car is hella sleeper, greddy exhaust and i wasn't reving or anything just steady speed(he never asked me about it) hella quiet.

anyways notices the "breather" and he notices the intake pipe, then calls in another officer who looks at it, and noticed the same things (there was way more that was going on there that they missed) so i get a speeding ticket and on the ticket it says i have to see the state ref and i shouldn't drive my car before.
(BTW THERE IS NO WAY MY CAR WILL EVER PASS A REF Without lots of $$ converting all back to stock.)

Now my question:
1.)My bro said i can just pay off the ticket without even going to the ref when it comes in the mail. (this is my first offense.) ????
2.)another guy told me jsut fight it and keep extending your court date as much as possible and he prolly wont show?
3.)who has been in this situation? and knows the best thing to do?
your experience?

as long as the motor is higher than year than ur car and ur straight. have all emission stuff plug up, etc.

In California, if asked to pop your hood, you're supposed to do it, its not a choice.

well i was told after, that u can say no, and yes they can tow your car, but they need to get a warrent and its a fat bitch and they usually wont.

I'm in the same boat as you right now, but i did tell the cop no I wouldn't pop my hood. He got all irate and used quite a few colorful words about me and my car to try and threaten me into doing it. I had him call his supervisor and the same thing happend but his supervisor was worse. Under cvc 2806 (i think thats the one) they can pop your hood for an "inspection", its not a search. Just add up the total of swapping it back to smog legal and compare that to about 350 bux (thats close to the cost of the ticket). If you pay the bail fine the ticket goes away, problem is that if you get pulled over again, if they pop your hood its probably gonna be another ticket and the vicious cycle starts over again. Hope that helps

If you say no to poping your hood. The cop would have to get a warent to search your car, and if he was a real dick, he could impound your car and wait the 2 to 5 weeks to get the warent, when your car is siting in the impound lot, and your paying the fee's, so u can say u No, if you want to risk that happen, MOST cops wouldn't go through all the paper work, unless he was in a bad mood and had nothing else better do, but thats about most cops now a days, so the choice is yours.


Good ways to get around it,
get hood locks and don't bring them keys with you *wink* so you are unable to pop the hood. Cop can still impound, but u have a good reason.
Don't mod your car
Don't give them a reason to pull you over.

If a COP tells you to pop your hood you could say no until they bring a warrent.

If a CHP or Sheriff ask you to pop your hood you have to or they could tow it away in suspession of street racing or some BS like that.

What i've heard with ref tickets is that if you want to pay the ticket fine, you can. And the ticket will be erased but then if you get pulled over and get another ticket another fine will be accessed. Just depends what you want to do. Either that or make it smog legal. I guess it just depends on how you drive your car and how noticable your car is to a cop. Good luck

He's correct.

I don't know about this, as I've never done it. If you decide to do this, and you get pulled over in the meantime, your car can be impounded for failure to comply, even though you're extending your case, the car isn't supposed to be on a public highway until the changes have been made, or the car meets BAR standards.

your experience?

I've been in this situation about 7 or 8 times. I would pay the bail when the notice comes.

what is your setup exactly? making smog legal might be easier than you think (unless your boosted). i had an obd0 motor in my car and passed it off as an obd1 motor to a ref. you can easily pass off an obd2 as an obd1 motor. in the end it's probably gonna be cheaper than paying off the fine. sometimes you CAN just pay the fine and not fix your car ($$$). but you'll still have a hard time passing smog (valve cover breathers aren't legal, and you'll fail visual even at a regular smog place)

they are all law enforcement and they all have discretion. chp, sheriff, school police, metro police, airport police.. they all have discretion when they pull you over. can a school police pull you over and pop your hood? yes can he write you a ticket yes. but do they normally do this NO.

and yes all have jurisdition to pull you over no matter if they are off duty (kinda risky, no radio no back up) or on duty or not in their city they patrol.

and dont forget those dark blue unmarked crown vic's that you see around they too can pull you over for any violation.

the only people in law enforcement that cant not pull you over are the civilian volunteers that use marked patrol cars. they can only radio in crimes or observations to officers

for me ive already failed once.
i have until feb 1 to try and get it bar'd but i dont think ill pass so im just gonna pay off my ticket. 400 something dollars.

anyways im still gonna try to get it bar'd because i don't want this situation to happen again.

actually...you should just pop the hood..b/c it isn't that hard to get a warrant. they could just radio in to get authorization...u might be sitting there for a lil bit, but they'll get it.
