Default I really need help

Ok my Type R has gotten hit twice in the last week and a half.

First time it got hit was at school when i was parked in the parking garage. I was in class when it happened. My friends mustang was parked next to me and stuck out 2-3 feet farther than mine, and the garage is one way.

Sooo the ford f-150 that parked next to me had to of been the person who hit me, because the mustang was so much farther out than mine, ne one passing oneway would have never of hit me. There is a 2 foot long scratch along my rear bumper on the drivers side. soo i dunno how to go about that. Its 400 worth of damage.

Then 2 nights ago, some idiot in a red lincoln backed into the front of my bumper when i was just sitting there waiting for a parking spot, with my GF in the car. sooo she witnessed it. I got all his info and he apologized for it and everything. Now he is claiming he is not going to pay for it.

ANd my parents are saying that its just gonna raise our rates if we pursue these hits. What should I do, the ******* told me he would pay for it, and now he is beign a dick and trying to turn things around on me

The worst part about it is that he is trying to tell me now that is was my fault.... and I am telling him "yea buddy i was stopped completely and u didn't stop coming out until i honked my horn" soo his story is just BS.

I need advice of what to do at LEAST about the second accident. (He hit my front bumper byt he way and put about a 4 inch scratch on it, into the plastic.)

actually i went to the police, apparently in MD, the cops dont actually write up reports unless there is a tow truck or ambulance involved.

Soo that sucks for me, now the guy is tellign me that his lawyer is going to call me with his insurance info. I am getting pissed, the dude is trying to act like nothing is wrong and i shouldn't be upset that my car (the car i take meticulous care of) is scratched all on the front bumper.

if you got his insurance information down, there is a witness so i think that you'll be ok. however, talking to a lawyer might be safe on your part.

well i don't think he is trying to sue me or ne thing because he knows he has no case and that i have a witness, and more importantly he knows he hit me while i was not moving at all.

I will let you guys know how it went.

since he hit you, i suggest going through insurance. you have a witness and he doesn't. the end result should be his insurance paying for all your damages

You must be really new at this "driving" thing. Either that or you don't have a clue how to call your insurance company to ask them a couple questions.

i'm pretty sure thats untrue, some insurance companies if not all won't take your claim as comprehensive or no fault without having a police report, and you should be able to get the police report after the incident.

when someone bumped into me last year at the highway, I got his insurance information. Called his insurance company, (AllState) . they were so nice about it, but she did ask me what was his car looks like, what color was the car. where was it damaged.

Then, his insurance company called him to verify, which he did. So they told me to go to this place to get a check for the estimate... I got a quote from an expensive bodyshop, and told Allstate the estimate, they gave me the check. I only use 1/4 of the check to repair my damages since i used a cheaper shop. (YOUR RATES WILL NOT BE AFFECTED IF YOUR INSURANCE COMPANY NEVER PAY OUT ANY MONEY)

So, you should do what I did, call his insurance company. If the insurance company call you back saying he denied hitting you, then you tell his insurance company that you bring it to court and you have witnesses. Also tell them things like.. I am little dizzy after the accident.. I am sure, they will pay you pretty quick.

He will be very stupid to call your insurance company if he did hit you. Cause it's not gonna get anywhere and he knows it.

Do that before going to lawyers, most lawyers charges you if there are no injuries involved. and it will get expensive. Or else they won't take the case. (remember they are in for the money, not your fairness)

Your rates should not go up if you are not at fault.

happened to my brother who bumped into a van (I could barely feel it). I don't even freaking see a scratch on the woman's car. My brother's insurance company told him, they paid out $9000 for it. She must had treated for breast cancer or something... and they raise my bro's rates.

WTF was that.

So it's a lesson

I live in MD as well, and got rear-ended in my LS a couple weeks ago. I called the police, and the officer told me the same news. My insurance company knew that this was the normal procedure, though, and weren't surprised when I told them that the police didn't come out.

If you contact your insurance comapny, they will get a statement from you and pursue the case, with their own lawyers if need be. They may also ask for a witness statement over the phone, or a signed affidavit from your girl. They can not use a not-at fault accident to raise your rates. In addition, the cost for them to find a bumper and finish it is under 2,500.. even if you were at fault, most insurance companies will not raise your rates for such a small dollar amount. Allow an adjuster close examination of your car, and be completely honest with them.

The biggest thing hurting you right now is that you can not longer make a claim on your first incodent... most insurance comapanies require a claim to be made in 24-72 hours.. so this incodent still might be under your deductable, but you MUST contact you insurance company ASAP since this person is going to try and get a payout for their damages, when they are at fault.

All in all, I am sorry to hear what happened, and I hope things work out for you.

Yea i called my insurance and they are gonna go after him. I think though because the front is sooo minor (1.5 inch scratch) I am just gonna take the $500 and put it towards a new hytech header.

In terms of my rear that got hit at school, i called them today, and they said they still will pay for it besides the $100 deductible becuase my car was not moving. So i think I will get my rear fixed, because it is alot worse than the front, but for some reasons is $100 less. I believe it is because of the emblem on the front.

They are not going to get a whole new bumper, the body shop i took it to to get an estimate said they sand it down or something and repaint.....

I think nightrider meant that you can potentially sue the guy. Not the guy suing you.
