Default Check Engine Light / Is It or Is It Not ??

Having a Repeat of Same problem that occurred back end of February, still cold & snow on the ground.. Couldn't start car remotely , could only be started at the Push Button (Safety Feature) I'm told.. Back in February Check Engine was acting like a Moody Person, come on and stay on for a short spell until I had to fill up the gas tank.. I would only fill the tank up till nozzle clicked off first time.. After about a month if it was a fly in the ointment it went away.. Last Saturday the Repeat began, wouldn't start Remotely but only via the Push Button Start.. Tank was 3/4's Full, I had to fill the Tank up this morning.. Light was still on when I got back home, then left to do an errand , Check Engine Light is OUT.. My Query, Does the Check Engine have to be on when plugged into a Diagnostic Machine ??
