BAR'ed in CA? I need your advice -- State Referee Question

BAR'ed in CA? I need your advice -- State Referee Question
So I am looking at a 96 civic shell, everything check out fine. ONly problem is that it is deemed a GROSS POLLUTER.
I guess this means that when I put a swap in it, I'll have to get it BAR'ed at the Ref.
My questions are:
1) As I understand it, the law in CA is that the engine must be from a similar car and be the same year or newer. e.g. My current B20 won't pass, but an H22 will?
2) How do they check what year your engine is at the Ref? I am having a hard time finding a 96 and newer H22.
3) JDM engines okay?

i would call dmv and state ref to see if you can still drive that car on public highways
