I don't know how he'll be able to tell other than the vin stamp on the engine might not match.
I guess it depends on the ref.

Are you saying you're keyboard at work doesn't have a caps lock button?
Or you're too insolate to turn it on and off between working and H-T?

State Ref? Never heard of such a thing, but that aside, i dont understand why it woudlnt pass. Any 96-00 civic uses OBD2 platform in their D16y7, D1678, and the lesser known D16y5.

The OP is in California, where it is law that the engine must be as old as or newer than the car it is in.
Meaning for his 2000 Civic he would need to have a motor no older than 2000. He also likely couldn't get away with putting a B20 in his Civic since the B20 is a truck engine.
I would suggest to the OP to call the state up though and check to make sure that it is law to have an engine as old as or newer than your car.

Crap, sorry... that was a typo. I put down the wrong year. Sorry about that.
Please contact the state referee or someone in that department who would know.

Found the info on a California state government site.
More info in this link:
http://www.arb.ca.gov/msprog/aftermkt/replace.htm
Replacement Engines
Entire engines can be replacement parts. As with any other replacement part, the engine must be identical to the original. If the replacement block or engine is obtained without emissions equipment, all the equipment from the original engine must be installed on the replacement block.
If the engine is not identical to the original then it is not a replacement part, instead it is considered an engine change.
Engine changes are a modification that must meet certain requirements to be legal (please see "Engine Changes").
Japanese Replacement Engines
Used engines imported from Japan can be used as replacement engines as long as the engine being used has been identified as functionally identical to the original engine. Please refer to the engine importers catalogue to determine if a replacement engine is legal for installation in your vehicle.
Engine Changes
Engine changes are legal as long as the following requirements are met to ensure that the change does not increase pollution from the vehicle:
* The engine must be the same year or newer than the vehicle.
* The engine must be from the same type of vehicle (passenger car, light-duty truck, heavy-duty truck, etc.) based on gross vehicle weight.
* If the vehicle is a California certified vehicle then the engine must also be a California certified engine.
* All emissions control equipment must remain on the installed engine.
After an engine change, vehicles must first be inspected by a state referee station. The vehicle will be inspected to ensure that all the equipment required is in place, and vehicle will be emissions tested subject to the specifications of the installed engine.

Re: (NOFX)
So what NOFX said is that you can put the an older engine as long as is it the same exact one and it has the same emissions? Ex. 96 d16y8 engine in a 97 since it is exactly the same engine? Or do the same rules apply as in "Engine Changes". Also, as far as passing, if you have the oem header and heat shield, i believe it'll cover the numbers on the head won't it?

You misunderstood.
Okay, so he wants to put a different engine in his 2000 Civic.
That means:
1 - The engine he's swapping in must be as old as or newer than his car. His car is a 2000. That means his engine must be one of the following years: 2000, 2001, 2002, 2003, 2004, 2005, 2006 or 2007.
2 - The engine must be from the same type of vehicle. In this case, it must be from a passenger vehicle. That means, as I said before, he can't put a B20 in his car because the CR-V is classified as being a light truck engine.
3 - If his vehicle is a California emissions vehicle then the engine must be also.
4 - He must keep all the emissions equipment that is coming with the new engine.
In short, no, he can't put in a 1999 engine in his 2000 Civic. Your example also isn't legal because of the year.

Lets say I have a motor and dont know what year it is. So what is the main way to I.D. the motor?
1} Vin # on the motor
2} Vin# on the head, Or....
3} Does the ECU contain manufacture date.
4} All of the above
Do I sound like a noob or what?
Thanx, BR

And does anyone think I might have a chance regarding earlier quote from
HAMOTORSPORTS:
(If the head has 99 stamped on it , it may pass for a 00. the majority of 00 heads were cast in 99 which the sate ref is aware of.)

Re: Is there any parts I can change to make 99 motor pass for a 00 civic (Budget Racer)
Who are you getting the motor from? Make sure theres a Bill of sale to prove that the motor was bought legit, in the bill of sale add the sellers name, address, drivers lisence number and phone number as well as the motors vin and serial number. The vin number the ref wont care to much about unless if it comes back stolen where you have a bill of sale.
Check the head stamp, if it says 9/8, you wont pass unless you change the head (smog equp. doesnt matter its the same). If the stamp is 9/9 then youll be ok because thats the stamp year in early model 00 civics. Use all your smog equipment.
If you still pick up the motor and its a 9/8 head just put a 9/9 on and say that the block is a replacement block.
Why exactly do you want to take it to the ref? Did you get a ref ticket for a swap before? Why not try to BAR that? Reason i ask is because 99.9% of the CHECK only guys dont care what motor you have as long as its a D series, some cops dont know the difference either, there mainly looking for the B/H/K swaps.

Re: Is there any parts I can change to make 99 motor pass for a 00 civic (Luserkid)
I am buying the motor from a guy here on Honda tech. The reason I will need to get it reffed is because it is not the original motor. I have never been pulled over and ticketed for an illegal swap, but I do want to swap out my D16y7 for the D16y8 sohc Vtec SUPERCHARGED . And if I want to get it legal (BAR) It will need to go to referee otherwise I wouldnt go. So the ref will check the vin# only to see if its stolen? It seems like they might as well check the year while they're at it but im glad if they dont.
Will my ECU have to be from a year 2000 or are all the D16y8 manuel trans ECU's the same?
Thanx for the head, and bill of sale info. Just as you said I heard that the head is the biggest deal on being the same year.

Re: Is there any parts I can change to make 99 motor pass for a 00 civic (Budget Racer)
The year will come up when they check the vin, but they look more for the head year because thats where the intake manifold/header and majority of smog equipment is (since those arent dated).
For the ECU im pretty sure you could get away with the 99 ecu since i dont believe 96-00 ecu are dated (92-95 are) but either way the most theyll do is hook up the ECU reader and if it reads your good
