Default passing smog

I have a 96 dx coupe with an aftermarket intake(a $30 imitation which btw works just as good). The problem is that I bought the car about 2 months ago from this guy. Instead of getting it smoged right away I slapped this intake on. My first question is am I going to have any problems passing smog with this intake? Cuz I know that AEM is CARB, so that's no problem.

Just put back the stock intake, get it smoged and then put back the performance intake.
