Alright, i got my EK coupe about a year ago and just recently got a neg hatch and i am selling the coupe now. I got the car from a small dealership type place, but it seeemd all legit and alright. It ends up that when the 2nd owner sold it, it has 140,000 miles, but when i bought it, it had 88,00, so when the dmv saw it, they put a in a mileage fraud record, and now the value of my car has dropped a shitload. Is there anything i can do to to sue the dealership or will i just have to go down there and beat the **** out of the guy until he gives me some money?

that's some hoe *** ****. you might be able to sue them for that. contact a lawyer and see what can be done.

Do you still have the paperwork from when you bought the car? In MD the dealer gives you an "odometer fraud disclaimer" with every vehicle they sell. Make sure there isn't a box checked on it thate stated it is not the actual mileage. If it states it's the actual mileage talk to a lawyer. Have you tried to talk to the dealer yet?

There should be no such thing. You cannot sell a car if the mileage is rolled back.

Fraud has been committed if ALL of the following are true:

1. There was an intentional mis-statement
2. There is material fact
3. The seller intended to induce reliance
4. The seller's representation was reasonably relied upon
5. Person's were harmed

If one or more of the above isn't true, the dealer didn't commit fraud. 2, 4, and 5 are definitely true. 1 and 3 depends upon if the dealer knew about the odometer rollback or not.

I have a friend whose wife bought an Explorer from a dealer and the mileage was not indicated correctly. The DMV caught the problem when the vehicle was trying to get registered. The dealer claimed no wrong doing. My buddy thought they couldn't do anything about it until they talked to a lawyer. They ended getting back all their money.

Go back to the dealer and asked them for the records from when they bought it from the 2nd owner. It should have the record of the mileage.
The "small dealership" is going to say I bought the vehicle like that to cover themselfs.
Get as much information u can be4 further actions.

PS- if u need the plaintiff forms(small claims) just lmk I can get it for u or I can give u info on how to file a claim. I advise you to not get an attorney because they will take atleast 30%+ other fees from you. Its better if u do it on your own.

I have found it best to never buy from a Russian. Now I'm not one to generalize nor label people, but from every Russian I've meet, ran across, or have done business with, EVERY single one is shady when it comes to cars... Everyone.

Make sure you go over everything with the lawyer, you don't want to get counter-sued...

This isn't much related, but I am changing my cluster out and don't want anyone to believe I did any sort of odometer fraud so I have been searching the city for a place to record my miles and this information so if I happen to sell it, the buyer doesn't think there was any rollback. Worst case scenario, I have to travel out to Texas to get this done, but then I can just visit a friend anyway .

Thanks for the advice, i met with a lawyer today and he is going to figure out what exactly is going to happen. And on carfax, there is a list of all the owners and how many miles were on the car when purchased by each one, and it shows the dealership purchased the car with 142,000, so they are fuc*ed.

Maybe the gauge cluster was swapped out. If it was, aren't you required to put the old mileage on that door jam sticker? I think I remember reading soemthing about that a while back.

Well it depends if the dealer ship knew that the mileage has been changed.If they trade it in like that i dont know if there is anything you could do.
