Is my handbrake frozen or broken?

Is my handbrake frozen or broken?
I got in my 97 civic cx and put down the handbrake but the actual brake is still on. The handle went down but the brake is on. If I let the handle go it wants to sort of raise back up. Is it frozen or broken? I didn't hear anything snap.
I have tried driving back and fourth and playing with the handle but so far nothing. I'm goign to get a heat gun or something to heat up the rear brake ad mabye it will come loose.
BTW which side is it on?
Edit: It's on the driver's side and yes it was frozen. Thanks!
